Review: I joined this gym in June 2015. The reason I joined this gym was, because I was told by the [redacted] it was a Crossfit gym. I was a member from June 2015 to October 2015. The monthly membership was $100 which was deducted on a monthly basis from my debit card. I had to cancel my membership due to being promoted at work and having to relocate. While searching online for Crossfit gym in my new location I noticed that Savage Elite Fitness did not come up as a Crossfit gym so I asked the [redacted] regarding this and he stated he was not a Crossfit affiliated. When I signed up for this gym I was told this was a Crossfit gym this is the reason was I joined not only was I told this, but on the gyms Instagram he promoted the gym as a Crossfit gym. I was really upset that I was mislead and signed up with false advertising. I asked the [redacted] to refund me the $500 I had paid for a gym that was not what I was told it was a Crossfit gym. [redacted] said he would refund me the money that it would take 3 days to be credited to my account a week passed by and I never received the credit. I reached out to [redacted] multiple times and he never responded. I was ignored and was never given my money back. I think this is unethical and people should be told what type of gym they are joining. I have pictures showing that the gym was promoted as a Crossfit gym I was unable to attach them, but I can email them if needed.Desired Settlement: All I want is a full refund for the money I paid for a gym that was not what I was told by the owner it was. Total amount $500.

Response:Not once did I say that my gym was a crossfit affiliation. My gym is broad in all exercise aspects we offer boxing, group classes, one on one training and more. I have a contract that the client signed that has nothing to do with crossfit and not one thing in that contract says crossfit training. There should be no reason for me to refund him $500 when I provided my services for those 5 months. He had no complaints during the 5 months that he was here. In the contract that he signed it stated that he needed to give the gym a 30 day notice to cancel, he text a couple days before his payment and was upset when it was charged. He wanted me to transfer that membership to another member and I told him I was unable to do that because it is not our policy. He then brought our race into it and blew it all out of proportion.

I am rejecting this response because: as shown on my last email I have pictures from his gyms [redacted] where he promotes his gym as a crossfit gym once I confronted [redacted] about this he quickly removed all the crossfit labels from the [redacted]. Not only do I have these pictures as mentioned before there are at least three people I referred to his gym which were told by him his gym was a crossfit gym quote "you should join crossfit " not only can I get written statements from these three individuals I can get at least three witness written statements from people that were present when the people I referred were there being told this by [redacted]. I'm not here to ask for anything I don't deserve. [redacted] promoted his gym as a crossfit gym not only to me, but multiple other people. Yes I did sign a contract which I didn't not read I'm not going to play the victim, but I trusted [redacted] at the time and felt he was being honest in summarizing the contract for me. When I asked him for a copy for my records he stated his copy machine was down, but would give me a copy on my next visit which he never did. What [redacted] did is unethical business practice he should have been honest about his gym from the start not use a big name affiliation like crossfit to promote his gym when his gym is not crossfit affiliated. If you need the pictures again or the written statements from the people that were told by [redacted] his gym was a crossfit gym I will be more then happy to provide these at anytime.

Here is the contract that you signed and never asked for, everything you need to know is on there, notice how everything says specifically GYM. I will refund you $100 because you moved cities and that's it. Who signs a contract and doesn't read it? I never trick my members into signing up for anything, but regardless move on with your life, don't you have better things to do than to bs with my business???

I am rejecting this response because: I already informed you of what I'm requesting that is a full refund of $500. If you don't want to refund me the money that's fine I will take this to court, I will also express my experience on media. I have facts and witnesses I can prove why I'm requesting this refund. I'm not hiding anything. You know you were promoting your gym as a crossfit gym that's why you removed the all the " crossfit" affilation from the business [redacted] after I confronted you about it, but as mentioned I have all the posts as well as the witnesses and testimony from the individuals you told this was a crossfit gym " come join crossfit". I feel very strong about this and this is why I'm taking the time from my busy schedule to address this issue. You can give me my full refund and end this or we can take the long way. If you would have been honest with me from the start you wouldn't be in this situation.
