I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.*** ***’s response to this matter is completely andfabricated The original contract, thecleared checks, the additional invoice for the second time he asked for money,as well as the documentation between us and the detective we contacted are indisputableproof of that. *** *** is a ***and his background check that we obtained since this incident is only furtherproof he is a ***. When *** *** called us on Monday 12/15/aboutpurchasing a system that was $more than what was originally agreed to inthe contract signed on Thursday 12/11/2014, we declined. After we declined he explained that theadditional $cost for this different system would come out of his profitsand that the original bid of $would not change. The contract we signed was for $for theentire job and as stated in that contract we gave him $(50%) at that time(12/11/14). Reluctantly, we gave him anadditional $(on 12/15/14) in order to get the job started. We asked for an updated contract reflectingthe additional $that we paid him as well as no change in the originalbid. There was no mention of purchasingmaterials from a “private contractor”. At the time this $check was exchanged, there was a brief discussionabout additional work that we would be interested in having him do that wecould discuss at a later time, however at no point was an amount of what wewould pay him for that work discussed nor was insurance money brought up inthis conversation as he alleged. Thework in question did not constitute “$300” worth of work, so I am not surewhere that number came from. As far asus “spending” the rest of the money and being unable to pay him for the work isludicrous, considering we could not even submit for the rest of the money topay him until the job was complete and contingent on if we were satisfied withthe work he did. His own contractacknowledges that fact and references it by giving days for payment becauseit is an insurance claim. The differencein insurance compensation recoverable beyond what was already paid isconsiderably less than what he is alleging we ask him to “increase his proposedbid” does not appeal to anyone’s common sense. We have never filed a homeowner’s claim and his allegations would costus more money, not “make some money off this job”. His previous response indicates that he could not purchasethe materials until “Monday” when in fact it was Monday 12/15/that hepicked up the additional $check to buy the materials in question andimmediately cashed it after picking it up. We have the cleared check proving this and discrediting his entiretimeline in his response. We were alsocontacted by the bank both times he cashed our checks. This was an additional red flag on top of theelaborate story he told us about needing to open a private account to cash ourchecks because of an ex- girlfriend having access to his company accountetc… Communication with *** *** ceasedentirely on Tuesday 12/16/until after law enforcement was contacted. The last contact from him was through textmessage communication claiming he was on his way to deliver the materials andmade no mention of his alleged car accident. The claim that he was told Tuesday evening that we “did notplan on moving forward with the contract” is completely fabricated. We tried numerous times to make contact withhim to find out what was going on and gave him until Thursday 12/18/tomake contact with us, which he did not do and we contacted the police. At that point *** *** took $from usfor a job we hired him to start 12/15/and complete Friday 12/19/andin which not only did he not start the work, he failed to deliver materialsthat he supposedly purchased with that money after telling us multiple timesthat he was dropping off, but then he ceased communication entirely. He voided his own contract and in turn stole$from us. *** *** broke the contract we entered into with him, fedus nothing but elaborate excuses and compulsive lies. There is nothing in the contract stating thatthe 50% deposit is non-refundable either. We had no reason to “change our mind” until *** ***’s conduct left usno other option than to proceed accordingly. Please consider the facts and the proof in this situationand let this information be known in the hopes that *** *** will not be ableto put another person through the same events that he has put us through. I did enter in a contract with the mentioned [redacted], but what he failed to mention, I told him that I could not get the 40 [redacted] system that I originally planed on installing on the carport in a timely manner. I said that I could purchase a [redacted] system from a private...
contractor but they would charge an extra 600 than what was originally projected. [redacted] agreed to this and I then drove approx. 50 miles back to his home for a check. When I arrived at his house his significant other and himself while standing outside under the car port asked me if I would increase my proposed bid $1,300.00 and submit it to the insurance company so they could make some money off of this job. They said they would give me $300.00 extra for doing this, I told them that I'm not into lying to insurance companies but if there is more work that is needed we could work something out. I did not make it back to pittsburgh till after 430pm. By this time I was unable to purchase material until the following Monday. Monday came and I was involved in a minor accident with my daughter. I notified [redacted] of this and told him that I was going to stay home with her for the day, Tuesday was looking like rain so we would be out on Wednesday. This message was sent via text. I received no response till Tuesday evening where he stated that he did not plan on moving forward with the contract any longer and he wants me to return the money, by this time I had all the materials purchased for the job, I told him this and also told him that I was unable to return the materials to the person I bought them from. And if I was to take them back to where he had bought them from they would charge a 30% rest allying fee if they would take them back at all. I asked him to reconsider having the job done, he refused. I told him that he is welcomed to his materials, they are sitting in my back yard, but I'm not going to run all over the place returning materials and trying to get people to buy them back because he is upset that I refused to defraud an insurance company because that is the only reason I could see why he doesn't want us to do the job, or he had spent the remaining money and would have been unable to pay us. The initial deposit 50% is non refundable, this assures us that we will be able to purchase the materials and that we will not schedule any other work other than that current customer. I still have his material which he has been notified on several occasions that he is welcomed to, but his doings cost me and my company 7 days without work. I refuse to pay re-stalking fees because a customer decides to change his mind, this is why there is a contract to assure that work is secured and to protect both of out interests, I advised [redacted] on several occasions that I would still like to just do the job and get it out of the way. It was only 2 days late from the projected start date. One day was due to weather and the other was due to exigent circumstances.
Review: On Thursday 12/11, [redacted] / SaraCo Roofing & GC came to give me an estimate for replacing my carport roof that was destroyed by wind 11/24. He told me that he would be able to do all of the work I wanted for $3200 total and could start work Monday 12/15. The contact states: Projected start date is 12/15/2014, with weather permitting job should be complete with in 3 full business days. Completion should be no later than 12/19/2014.I paid him $1600 up front for materials and he told me that he would probably deliver the materials Saturday the 13th or Sunday the 14th. Over the weekend he told me that their order for materials would not be ready until Monday morning. On Monday [redacted] told me that the [redacted] roof system was out of stock and he could get a better system ([redacted]) for $600 more same day, but that he needed $600 and he would take it out of what I owed him later. He said he would still deliver all materials to my house on Monday even though the weather was not good to do any work. He never delivered anything and sent me text messages near midnight about having to watch his daughter and would deliver everything in the morning (Tuesday 12/16). On Tuesday morning he told me that he was waiting for the rain to let up before heading to my house to deliver the materials. Thats the last communication I heard from him and he did not responded to any text messages or phone calls until 12/19 (the day my roof was to completed). I explained that he broke the contract based on the start / finish dates, never delivered any materials to the work place (my house), and stopped communicating completely. I also ran a background check on him. I told him that I wanted all the of money back. He gave me a lot of the same excuses that he mentioned before. He said the supply store will charge him a 30% restocking fee. Based on that, he should be able to return the materials and give me back $1540 immediately, owing me $660 remaining, or deliver the materials with receipt.Desired Settlement: I would like a full refund of the $2200 that I have provided him (part of the $3200 contract), since no work was ever started and no materials were ever delivered to my house.
