I am rejecting this response because: it contains: Untruths, Inflammatory accusations,and most importantly no viable legal option to have my X-rays / medical records turned over to me!
I have a legal right to receive my medical
records within days with a detailed itemized cost receiptBoth have been denied to me after repeated attempts to obtain themMy initial request was on April 2014!!
I have had to cancel three appointments with my new dentist due to this negligenceI ask myself how can MrRai in good conscious further deny me my legal rights when he full well knows that he is delaying my much needed dental treatment!?
I have offered him a reasonable sum for my recordsI have even offered to pay the differenceof the cost for the original x-raysI have supplied him with the laws governing theses requests which he repeatedly chooses to ignore
He and especially his secretary have caused me pain,now months of missed treatment opportunities, and the accompanying unnecessary hardships, due to their lies, negligence, and refusal to simply follow the guidelines set out for all dentists
This matter will be put to rest when I have my medical records and not before.
So again for the umpteenth time provide me with an itemized receipt for my records which follows the law set by the State of California, and not want you have done in the past or would like to do presently, but what is actually allowed by law and I will pay that forthwith
Stop Denying Me My Legal Rights! I also have a right to change my dentist without retaliation, i.erefusal to turn over medical records, accusations against my person, as well as fees exceeding those for the actual cost of reproduction
The law regulating patient right to access to medical records is found in the California Health and Safety Code Section 12300-123149.5.It gives patients the right to:Inspect records during business hours within five (5) days of presenting a written requestReceive copies of records within days of presenting a written request
Receive x-rays or tracings within days of presenting a written requestThe law gives the dentist the right to:Charge a reasonable clerical cost for locating and making the records availableCharge $per page (or $per page for microfilm copy), as well as reasonable clerical costs, for copies
*Charge reasonable costs, not exceeding actual duplication cost, for x-ray copies.*
Prepare a summary of the records as an alternative to providing copies or allowing inspection
Since you have made this process so exceeding difficult, and have exceeded the legal time allowed to turn my records over to me or my new dentist by days!! ; I now request my original x-rays and not copies FOR THERE IS NO POSSIBLE REASON IN THE WORLD FOR YOU TO HOLD ON TO THEM SEEING THAT I WILL NEVER BE YOUR PATIENT AGAIN!

Review: I made a written request to the office for my dental records to be transferred to another office. I sent an accompanying check for the service with the request for a detailed itemized receipt for the service if it was deemed my check did not cover the reasonable actual cost as set out by the law. The Dental Board of California informed me that I was within my rights to request and receive such a detailed receipt.I also sent a follow up email after 10 days requesting a status update to my request. After 15 days, the time limit set by law for such a request to be completed, and I had still heard absolutely nothing from the dental clinic ! I called requesting contact, i.e completion of my request, itemized receipt as verification of allowable cost to be paid so that I could receive my dental records. I received an email from the dentist giving his reason for his excessive fee request but again no itemized bill. Reason :his secretary lacks the technical skill necessary to make readable x ray copies requiring him to do her work hence the price. This price is unacceptable and not justified as set out by the law :California Health and Safety code Section 12300-123149.5. Additionally it is totally unacceptable that my requests for my medical records have been stonewalled by the office secretary. She has had more than 3 weeks to complete the task and nothing has been undertaken!
