TO CANCEL MY MEMBERSHIP WITH THIS GYM.I HAD A MEMVBERSHIP WITH THE GYM FOR 1 YEAR. I WENT INTO THE BRANCH MONDAY OCTOBER 6 2014 AFTER 5 PM AND EXPLAINED THAT I WANTED TO CANCEL MY ACCT. SPOKE WITH CUSTOMER SERVICE MEMBER [redacted] AND HE EXPLIANED HE WAS GOING TO CLOSE MY ACCOUNT. I EXPLAINED THAT THERE SHOULD NOT BE ANY MORE PAYMENTS TO GET CHATGED TO MY ACCOUNT, HE STATED THAT THERE SHOULD NOT BE BUT IF THERE WAS A PAYMENT HE WILL HAVE THE GIRL IN THE MORNING CALL ME. FROM OCT 6 2014 TILL TODAY WED. OCTOBER 15,2014 I NEVER RECIEVED A PHONE CALL, OR ANYTHING TO STATE THAT I OWED ANYTHING, TODAY MY BANK ACCOUNT WAS CHARGED 85.99 FOR A NEW YEAR AND I CANCELLED ON OCTOBER 6 2014. WHEN I SPOKE TO [redacted], AS SHE STATED WAS HER NAME, SAID THAT THE MANAGER WAS NOT IN AND SHE WILL HAVE THE MANAGER CALL ME BACK. I GAVE THE CUSTOMER MY NAME AND PHONE NUMBER AND THE CUSTOMER SERVICE REP WAS EXTREMLY RUDE AND HUNG UP THE LINE AFTER TAKING MY INFORMATION. IF YOU ARE A BUSINESS YOU SHOULD NOT BE TALKING TO YOUR CLIENTS THE WAY THEY DO.Desired SettlementMY ACCOUNT WAS CHARGED 85.99 AND A FEE OF 35.00. I NEVER AUTHORIZED THE ACCOUNT TO BE CHARGED SINCE THE ACCOUNG WAS CANCELLED. Business Response Mr. [redacted] draft bounced in September causing his monthly dues to be returned to us. Our policy is to send a letter out explaining this and then double draft the account the following month. Mr. [redacted] came in on October 6th to cancel his membership signing a form that clearly states we require a 30-day written notice to stop all drafts. As it was after the 1st of the month and our billing cycle was already submitted to the bank for October, there was nothing further that could be done except stop the draft for November due to the notice of cancellation. The reason his draft was higher than normal was because of the past due amount from September being included with the October draft. The manager, [redacted], spoke with Mr. [redacted] several times explaining this to him and outlining our policy of 30 days notice for cancellation. This was not a sufficient answer and Mr. [redacted] demanded a refund which was not given due to the fact that we have his signature on documents which clearly state our policy.
