On Wednesday, Dec. 4, 2019 I met with Sandra P., with whom I had previously met and who had assisted my husband with accounting issues, to discuss issues regarding distribution of an IRA annuity that consisted of pre- and post-tax contributions. Sandra told me that she would provide me with the necessary directions and communications to send to the IRS to establish that a tax had previously been paid on a proportion of the annuity distributions. She directed her assistant, Colleen, to copy my documents and for me to return when ready to file my taxes with a copy of 1040. Dec. 12, 2019 I retrieved my original documents that Colleen had copied. Feb. 17, 2020 I went to Sandra's office, Colleen scheduled the appointment for March 31, 2020. Sandra was present and told me she would have everything together for me and not to worry. Mid March Colleen called to reschedule for April 9th at 10:00 am. Colleen e-mailed directions to submit copies of all materials to their secure portal for teleconference. March 30 SecureFilePro account was created. Requested information was submitted. April 2nd, I received an e-mail from Colleen stating, "Unfortunately our office will not be able to help you at this time... we will only be working on our current clients." I phoned stating I was a client and there must be some confusion. Staff person said she would check with Sandra. April 9, 2020 at 9:00 am, an hour before our designated appointment, Sandra's staff person phoned and told me Sandra WOULD NOT MEET with me or help me. Sandra agreed on two separate occasions to provide me with the necessary information to send to IRS. I trusted her expertise and her commitment to provide needed documents to IRS. Her office has my documents, physical copies and in secure portal. Her decision to not meet with me one hour before our appointment, breaks an agreement, demonstrates a severe lack of professionalism. Caution to anyone with whom she agrees to provide her services as she may, at the last minute refuse service.

Desired Outcome

Other (requires explanation) I want all copies of my documents returned via Registered Mail that Sandra, Colleen and/or other staff made. I want the Secure Portal closed and the information destroyed - permanently. And I want verification that this has been done. I want an apology from Sandra stating that she was irresponsible when she told me that she would have the information together for me to send to the IRS, as it appears she had no intention of meeting with me and providing me with those documents/letters/guidance.

I've had two free consultations with the consumer. The first was in January 2017 when she contacted my office upon opening a new business. I provided resources to her to assist in accumulating information for her tax schedule, and then I did not hear from her again because she and her husband prepared their own return.

I heard from her again in November 2019 on a matter relating to improperly filed returns relating to IRA contributions in an annuity. She wanted to contract me to review the return prepared by her husband, and I agreed. As she states in her complaint, she picked up those original documents on December 12, 2019.

She set up her appointment, but would only provide certain documents for my review. Since I am a licensed CPA, I need to review the return in its entirety if I am going to issue an opinion on the accuracy of the filing. Doing so takes almost as much time as preparing the return. When my staff was explaining this to her, she rebuked the notion and said she should receive a discount for the work she had done. She never did provide the necessary documents needed to review the entire return, nor would she agree on the fee estimated by my staff. Hence, we were at an impasse, and this, during the growing COVID-19 pandemic.

My staff spent considerable time scheduling with the consumer and arranging for the required documents. On April 4, 2020, she uploaded the remaining documents she thought we needed to assist her. My staff continued to reach out to her to discuss both the price and the manner in which I would be able to assist her leading up to her appointment. Since we were unable to agree on a price or on a manner in which I would perform the work, we cancelled the appointment. Our records show she did not provide us with any original documents, other than those she picked up on December 12, 2019. All future records were submitted via our portal, which has since been deleted. We have nothing left of her records or name, except on our calendar. If there is something specific she believes we possess, please ask her to contact my assistant and provide those details.

I wish her the best, but I have to have an agreement on terms before I commit my time. She did seem to take offense at not being a client, but I have yet to have a billable service or payment from her, so she was not a current client, but rather a potential client.

She has until July 15 to file her return, so she was not inconvenienced by the cancellation either at that time. I wish her the best in finding someone who is better suited for her needs.

I have reviewed the comments submitted by S. P. in response to my claim to the Revdex.com filed on May 14, 2020. I have significant concerns regarding her response and the fictitious information that she provided therein. I submit again that S. P. did not deliver promised products that were agreed upon. Additionally the manner in which she and her office staff have conducted business and the blatant fictitious claims in her response to the claim I submitted demonstrate a significant lack of professionalism. I again request the return of all copies of documents that were made by her staff, as described in my letter dated April 4, 2020 and mentioned in the original claim received by the Revdex.com on May 14, 2020.
As stated in my complaint I met with S. P. on Dec. 4, 2019. During that meeting she agreed to provide to me necessary communications to submit to the IRS regarding tax liability related to distribution of annuity funds from an IRA containing both pre- and post-tax contributions, the process to avoid filing amended returns for 9 years in relationship to form 8606 which had not been filed, a formula to use to determine non-taxable portion of annuity distributions and the percentage of Federal tax to be withheld from distributions. She told me that the information she would provide to me should be submitted to the IRS separate from the form 1040, as that would only cause confusion by the IRS. The document that she was going to produce and give to me would be sent to the IRS independently.
During our December 4, 2019 meeting I provided documents from investment companies where the IRAs were created, statements showing amounts of contributions to each IRA, the first page of our filed returns for the related years showing no deduction for IRA contributions, and a statement about the annuity distribution including the base amount and value. I also provided spreadsheets which organized the data for each IRA account. The agreement we had was never to include the preparation/review of our tax form 1040 for 2019 nor to determine accuracy of our filing for 2019. She told me that I had provided her with all of the documents necessary for her to put together the agreed upon response, to leave the documents with her for her staff to copy, and for me to return in 1 week to retrieve the originals. I asked, at the end of that meeting, how much she would charge for this service, how she calculated a fee for this and she told me that we would discuss it when I returned for the appointment to receive the information from her. She told me that the appointment should take place when my husband and I were ready to file our form 1040 for 2019. This was the one and only time that a fee was discussed, no dollar amount was presented to me at that time or any other time. Her fee for service was never presented to me by her or any of her staff at any time, in any manner. Her responses to the contrary in her response to my complaint are blatantly fictitious. I returned to her office on Dec. 12th and the original documents were returned to me by her receptionist, who told me she had just copied them.
My husband had, in the past year or so, used her service for a tax related family matter and had paid for her service. S. P. was aware that my husband and I file joint tax returns. I believe that when someone agrees to provide you with a product, and you have left financial documents with them for them to make copies of those documents, that you are one of their clients, not a potential client. Therefore, claiming that "we" were not her clients is not supported by the facts.
Mid-February 2020 I scheduled the appointment, in person in her office, for March 31st to receive the agreed upon products. S. P. was present when her assistant made the appointment and again stated to me "not to worry" that she knew what needed to be done to resolve the issue.
Her assistant telephoned me the end of March to move the appointment to April 9 and to inform me that due to COVID-19 the meeting would take place via telephone. The assistant told me that they would be creating a SecureFilePro account and that I should submit documents into that account.
My husband and I submitted into that SecureFilePro account, on April 4th, copies of some of the documents that her office had previously made copies of and a 2-page summary letter clearly stating the individual points of the agreement that were made in December 2019 followed by the dollar amounts of contributions, and the pre-and post-tax contributions, gains from those investments and a ratio of those post-tax contributions to the value of the annuity policy. I also included a statement that if she needed copies of documents for the preparation of the information agreed upon, that I would submit them. (This is the one and only date that we entered information/documents into that SecureFilePro account.) Her office had made copies of these documents in December and she had told me that the documents she made copies of were sufficient to put together what I needed. There was no perceived need or requirement for us to submit additional information to her for review, including our prepared 1040 tax return as she was not asked to, nor expected to review our return for accuracy.
The 2 subsequent conversations with her staff were brief. During the first I repeatedly told the assistant that the purpose of the April 9 meeting was to obtain information related to IRA annuity distributions and NOT for S. P. to prepare or review our form 1040 for 2019. I was told that she would relay that information to S. P.. The second was on the morning of April 9, one hour before scheduled appointment time, informing me that S. P. would not speak with me, and would not provide service to/for me.
The response by S. P., "We have nothing left of her records or name, except on our calendar." quickly brings to mind the following questions: 1. What happened to my documents (about 35 pages) that her assistant copied? 2- What happened to the pages of notes that she took during our December 4, 2019 meeting? Additionally, her response, "If there is something specific she believes we possess, please ask her to contact my assistant and provide those details." My letter dated April 4, 2020 clearly identified those documents. I am led to conclude that she and her staff are not able to keep track of client documents that they have made, or to retrieve and/or return them to clients and are not organized sufficiently to have safely filed the notes from meetings with clients including the agreements made during those meetings.
The comment by S. P., "She has until July 15 to file her return, so she was not inconvenienced by the cancellation either at that time" again demonstrates her lack of professionalism. Had I known that she was not going to provide me with the information that she told me she would, to resolve the issues with IRS related to post-tax contributions to IRA accounts and not filing form 8606, I would have secured the services of another accountant that would have provided me with that information. Cancelling this long-awaited for appointment one hour before the appointment time, on April 9th, 2020 is a 4-month delay in securing the necessary assistance from a competent and more reliable CPA. Additionally, to locate, interview and secure the services of a CPA during COVID-19 is a big inconvenience.
