I went to the Spa October 21 for a massage and my 13 year old daughter had a facial. My daughters necklace white old gold necklace with a diamond V on it is gone. The spa says they do not have it and my daughter never picked it up when leaving. The necklace was taken off my daughters necklace by the esthetician, not sure why as she was having a facial. When done the facial the esthetician did not put the necklace back on her and only told her to pick it up on her way out. My daughter has a absent memory, one of her challenges, and did not pick up the necklace. Now the necklace is gone. Spa is saying nothing was in the room when it was cleaned up after my daughter left. I have never allowed my daughter to take off her necklace. She has been wearing it for the past six months and is a keep sake. I'm not sure why it was taken off and why it wasn't put back on her. They are responsible for my daughter and her belongings as she is a minor. I was in another room they could have also brought the necklace to me directly.
I have contacted the spa and they say the necklace wasn't there and it hasn't turned up. I have called in numerous occasions to rectify this matter, however, I haven't heard back after they told me it wasn't left there.
They took advantage of a minor as they took her necklace off and did not put it back on her. Their responsibility once they took it off her neck. They should be responsible to replace it.
I just want the necklace and pendant replaced.
We appreciate the frustrating complaint filed by Ms.y. We had heard from the complainant that her lawyer was involved so we're not sure if the Revdex.com is in a position to mediate at this time.
It is common practice to remove jewelry from the face and neck area prior to receiving a spa facial service, despite Ms.y's objection to this. This has been protocol for us during the 20 years that we've been in business. Ms.y's daughter was reminded to collect her clothing and her necklace her service provider at the end of the treatment which was being stored with her clothing on a chair in the same room that the service took place. Due to high turnover at this location, we immediately cleaned the room to prepare for the next service and we didn't come across any personal belongings. Ms.y's daughter was waiting in the lounge area after her service and we certainly would have approached her if we came across her necklace or any other leftover belongings.
As mentioned, we have been in business for 20 years and we have a very good reputation. We average a thousand people per week visiting our facility and we cannot be held responsible of bearing the cost of replacing personal property that has been lost and we don't believe that we have a legal obligation to do so.

The esthetician had no business taking off my daughters necklace, None. And when she did take it off, you became responsible for that necklace. She took it off her she was responsible to put it back on her. Not enough to just say to a child, "pick up your necklace on your way out." Furthermore, her necklace was not with her clothes. Her clothes were hanging in the room and her necklace was left on a chair.

You do have a responsibility to replace lost valuables because you took it off her. I should have been informed of this practice, I was there, the whole time. You had ample opportunity. Furthermore, I didn't sign anything saying I am responsible for my daughters belongings. If I was aware of this practice I would have taken the necklace myself and kept it safe.
In every service industry the common practice is the same, they become responsible for lost, broken or stolen belongings once they take it in their hands, unless they've signed otherwise.
When I get my vehicle detailed and they remove things from the car to clean it, are they not responsible to put what they removed from the car back into the car? Or do they tell client to pick up their things on their way out? And if something is lost or broken they must replace it.
If it's a schools practice for the teacher to take their students phone for example, the teacher is responsible to give it back to the student before they leave. Because if that phone goes missing or is lost, misplaced, or broken, the teacher is responsible because she took the phone.
While in your care, you are responsible for my daughter and her valuables. And her necklace would not have gone missing if it remained on her neck, or you gave it to me, or you just put it back where you took it from, around her neck.
A reputable business would recognize their mistake, apologize and replace what was lost, or taken.
