Feb. 19, 2015Dear Representative Revdex.com,
I am writing to you in response to claim #[redacted]. We are denying responsibility to this claim for the following reasons; our customer brought his vehicle in for PA state inspection and emissions related repair. His vehicles inspection had...
expired by several months. After emissions related repairs were performed, the vehicle had to be driven to reset monitors. We often do this as a courtesy for our customers because it is legal for our inspection mechanics to drive a vehicle with an expired inspection and illegal for the customer to do so. We do this at no additional charge. The manor in which a vehicle must be driven for the monitors to reset would be inconsistent with causing damage to our customer's transmission. The vehicle must be driven at 40-50 mph at constant steady speed for about 20–30 miles. When our customer dropped his vehicle off, he stated, “I just want to fix this POS and sell it. I’ve already put to much money into it.” He had also admitted that his uncle has had the transmission out of the vehicle to perform previous repairs. Our company has never performed any repairs on this vehicles transmission to suggest that we would be liable for the transmission failure. There is no evidence to support that we mishandled or abused the customer's transmission. We also have no maintenance records to suggest that the customer had properly cared for the vehicle. There are however, several posts made on face book by our customer about taking the car to maple grove to race it. After speaking to our local Volkswagen dealer, they identified this vehicles transmission as a known common fail component for this vehicle. When I called the customer to notify him of what had happened, he came in promptly to pay the bill and with no complaint. We discussed him storing the vehicle here for a period of 2 weeks. He indicated that he was going to try and locate a transmission and bring it in for us to install. We had no further communication with the customer for over 30 days. His vehicle remained on our premises for the duration of this time for which no fees have been collected. After more than 30 days, the customer came to our business and indicated that after speaking to several lay persons (friends and family) about this matter, they had suggested he report us to the Revdex.com. Unbeknown to me, he had already done so at this time. This was the first time the customer had expressed any concern with this matter. After consulting our attorney, I then called our customer and informed him that we will not be covering the cost of his repairs and at the advice of our attorney, requested that he remove his vehicle from our property within 24 hours to avoid $85 a day storage fees. I waited till the weekend to contact the customer so that he would be better able to accommodate the request because he had indicated several times that he was going to have a hard time removing the vehicle. He also stated that he was unemployed and having financial difficulty. This customer was a previous employee of another business partner and was dismissed do to questionable behavior at work and chronic tardiness. It is my conclusion that he has filed this erroneous claim for retribution purposes.Sincerely,
