Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below [Mr***'s response and fabricated statements and recounting of events leave me no alternative than to seek recourse through legal channels In addition, Mr [redacted] would appear to have libeled me with his statement that I've made terrorist threats to him and/or his employees and his company This is absolutely untrue and I will immediately be engaging legal counsel to file a civil suit against Mr***.] Regards, [redacted]
Review: Engaged [redacted] Enterprises in October, 2012 to remove surface rust and repair/repaint two trunk areas on my car.
Repair/repaint work in the rear trunk area was never satisfactorily completed after numerous attempts over the course of 18 months. Specifically, paint continuously failed to adhere to repaired surfaces. Of note - the most common reason for poor paint adherence is improper prep work and/or an improper paint application process. This was brought to Mr. [redacted]'s attention immediately after the initial failure. Mr. [redacted] stated that the lack of adherence was due to excessive heat from the exhaust system beneath the rear trunk area. He suggested that new heat deflection material be installed above the exhaust and beneath the trunk. I declined his offer and requested that he repaint the affected areas.
Several months and several more attempts with successive paint adherence failures prompted Mr. [redacted] to suggest that add'l rust in the rear panels of the vehicle (not immediately adjacent to the areas where paint was failing to adhere) was the root cause of the problem.
At this time (December 2013), I decided to solicit feedback from other reputable body shops in the area as to the reasons for paint adherence failure. Each facility advised that improper prep work and the introduction of moisture, contaminants and/or pollutants are the primary reasons for the failure of paint to adhere to bare metal that has just had surface rust removed. I informed Mr. [redacted] of the very similar feedback received from three different shops and it was at this time that he did proffer that one of his resources (no longer with his company) may have not prepped the areas correctly prior to painting.
Told Mr. [redacted] that I was taking the car elsewhere to have the repairs completed and that I expected to be reimbursed for all labor and materials associated with his deficient repair work.
After much prompting, he advised that he would refund a TBD amount at a later date.Desired Settlement: I have been endeavoring to determine a refund amount with Mr. [redacted] for almost a year. He has either not been available or not ready to discuss a refund.
In the last two weeks, Mr. [redacted] and I have exchanged e-mails in an effort to determine a fair refund amount. Mr. [redacted] offered $200 which, based on the $1300 paid to [redacted] Enterprises for partial repair work, is insulting. The other repair facility correctly repaired and repainted the rear trunk area at a cost of $880 and this amount is comparable to estimates received by other reputable body shops.
I have suggested to Mr. [redacted] via e-mail that an acceptable refund amount would be $650 (half of the $1300 already paid) for the work performed which was not satisfactory. This amount does not include any of the costs associated with my lost time nor the repeated inconveniences of returning the car to Mr. [redacted] for additional repair attempts.
Mr. [redacted]'s response of "I'm done with this" suggests no refund is forthcoming.
