To Whom it May Concern,*** *** signed an agreement of July *** 2015. According to Paragraph of the agreement it states "As security to ensure payment, PINELAWN retains title to the lawn crypt plot until paid for in full. If two payments become past due, PINELAWN may
cancel this agreement. In that case, PINELAWN will keep the balance paid up to 20% of the total purchase price of lawn crypt plot (s) as sales, administrative, ministerial and processing expenses for PURCHASER'S failure to fulfill this agreement. This amount is the amount of exspenses hereby agreed to by PURCHASER and PINELAWN for default". Since *** *** had opened the account in 2015, we have sent several notices with the attempt to bring the account up to date. On June *, 2017, after months of non-payment, we sent a final notice to *** *** with three options 1) to bring the account up to date by sending in a payment for full arrears; 2) let us know if *** *** is unable to pay the full arrears but wishes to keep the account and request that we contact him to review any possible alternative options; 3) confirm that you no longer wish to continue to make payments, you wish to cancel the account, and that you are aware that Pinelawn will retain 20% of the total purchase price. That selection form was filled out with option selected and mailed back to us by *** *** and received by our office on June *, 2017. The account was cancelled on June **, as per *** ***'s request. Since *** *** paid in a total of $which included the deposit, which is less than the 20% of the total purchase price, Pinelawn Memorial Park retained all the monies paid, as agreed by contract. One June **, we mailed a letter to *** *** confirming his request had been fulfilled and that the account had been cancelled. In the letter, we stated that *** *** would have a non-assignable credit in the amount of $whch may be applied only toward the purchase of a cemetery plot or mausoleum space at Pinelawn, for a period of up to five (5) years. We feel we have done everything possible in attempting to keep *** ***'s account up to date.
