S & S Logistics

Review: On December 22, 2012 we entered into a Shipping agreement with S & S Logistics LLC to haul three Caterpillar Motor Scrapers from [redacted] to [redacted]. We were required to pay for half of the transportation cost up front in the amount of $22,162.50 USD. On December 24, 2012 the funds were wired direct to S & S Logistics bank account.During the month of January S & S logistics was supposed to pickup the motorscrapers and haul them to [redacted]. Every time that we were told the scrapers were going to be picked up it never happened. On January 24, 2013 we sent S & S Logistics a fax letting them know that they have not fulfilled the contract and they needed to reimburse our deposit of $22,162.50. As of today this still has not happened. Paragraph 10 of the Terms and Conditions of S & S Logistics Shipping Agreement provides that all deposits will be held until the completion of the transport and furthermore that in the event S &S Logistics LLC is unable to complete transport, the entire amount of the deposit will be refunded to the Customer. It is our position that they are in breach of their obligations under the Shipping Agreement and are indebted to us in the amount of $22,162.50Desired Settlement: Refund the amount of $22,162.50 USD
