On 08/03/I hand delivered the contract to the customer, and we all agreed on the contract including the payment scheduleWe agreed the start date would be between 08/24/- 08/28/Plans were drawn; permits were acquired by SNR
ConstructionWork began on time 08/27/with the digging of piers; the second payment was dueThe pier inspection was approved by StLouis County on Friday morning, 08/28/15, and we poured the concrete piers later that afternoon despite the overdue paymentLumber delivery was scheduled for Monday, 08/31/by a 3rd party supplierAfter the supplier notified me that the lumber would not be delivered until late afternoon, I had them reschedule the delivery to first thing Tuesday morning, 09/01/The customer was notified of this in advance and that we needed access to the driveway to carry the lumber to the backyardThe delivery driver arrived at 6:and rang the doorbell several timesAfter no response he called me to notify me of the situationI called the customer to notify him that the delivery driver was there and that he would need to move his vehicles from the driveway for the deliveryUpon arriving at 8:am Tuesday morning 9/1/15, I asked the customer for the second paymentIt was past due at this pointWe carried the lumber down to the rear of the yard for the next couple of hoursAt approximately 10:am we knocked on the rear door for an extension cord to be plugged inAfter no answer for an extension cord and the past due payment, I decided to leave the projectApproximately minutes after we left the site the customer contacted me via text message and said, "before I leave for a while, will you need a power cord today?" This customer knew we were there to begin the framing portion of the project, the lumber was delivered and carried to the rear and he knew we needed power to start constructionHe knew there were no power outlets on the rear exterior of the houseI notified this customer of the reasons we left the site via text messageAfter notifying the customer of the delivery being rescheduled, he called me at 10:am 8/31/concerned about the project not being completed by the holiday weekendI mentioned via text that my guys had requested off Friday thru Monday for the Labor Day weekendThere were never any completion dates mentionedI only stated that it was a small job only taking about a week after the piers set hardThis customer never asked me to complete by a certain dateThe second payment still has not been made and now this customer is wanting a refund, to keep the plans, permit, the materials, and the labor that was performed and for me to abandon the projectThis customer has made no attempt to send me the payment and is in breach of the contractI requested the second payment that's past due and the final payment due to an anticipatory breach of the final paymentI notified customer that my work schedule has moved forward until this situation is resolvedI tried to make arrangements to have the stairs repaired temporarily for the customer, but he notified me later that he made the repairs to the stairs via text messageI also note that the customer made arrangements to use the front door of the house to bring the dogs to the rear of the yard; the removal of the stairs does not warrant the removal of the backyardThis customer is not being reasonable, and in all my eighteen years of business, I have never had a complaint filed against me
