As Management Agent for the Owner of this property, we foundthat many tenants at the property were in non-compliance of the lease relative topreventative maintenance of their HVAC unit...

In section 13.2 of the 13th Articleof the lease (a copy of which is attached), it is the tenant’s responsibility to maintainpreventative maintenance in accordance with the manufacturer’s specifications. If amaintenance contract is not in place, Landlord has the option to provide for suchmaintenance.In the interest of both the Owner and Tenant, we made the decision to provideHVAC preventative maintenance service on all the HVAC units and pass the expensethrough the operating expenses. The service would provide tenant with a well maintainedunit, 24-hour emergency service, and eliminate the need for individualmaintenance contracts. Additionally, it would provide assurance to the Owner thatall the units on the buildings are being maintained.We included this expense in our 2016 budgets and communicated the additionalservice in our memo to tenants dated October 23, 2015. (a copy of which is attached).Mr. [redacted] did contact Ryan relative to obtaining the scope and cost of services of ourcontractor, of which we provided. He indicated that he would rather utilize hismaintenance contractor for the services, and we agreed to credit for these servicesupon a signed preventative maintenance contract (see attached e-mail)To date, we still have not seen a signed contract for this location.
