Review: I am writing this in dispute of [redacted]s invoice dated July 19, 2014, which was received on July 21, 2014, in the amount of $4020.70 via e-mail submission. I never agreed to any contract with you for the amount of $4020.70, which [redacted] arbitrarily charged me. On April 20th, 2014, he requested my e-mail address via text, and despite my prompt response relaying my e-mail address, he failed to deliver any form of contract or bid as promised. [redacted] asked me to send him a text to pull a swimming pool permit. I allowed him to pressure me into pulling the permit despite his failure to give me a written contract per my many requests, and when I asked him for a written contract for the final attempt, closing our business together, [redacted] called me and my Mother a [redacted] When I contacted the Contractor’s Board for help, I was informed that Mr. [redacted], as a license contractor, is aware of his responsibilities under the law, and he knows better than to act outside of the regulation.I made several request of [redacted] to provide me a written description of your estimated bid and a written contract to determine my agreement or disagreement with his proposal of work to be performed but he refused. After several failed attempts in April to receive a written contract, I reduced my request to writing on May 12, 2014, May 13, 2014, and July 14, 2014, however, he failed to provide me with an estimate in writing, and or a contract. He also failed to provide proof of general liability insurance per California business code 7159.3, agreed consideration for work to performed “a - contract”, swimming pool contract with only 10% down payment requirement and or $1000.00 whichever is less according to the law, he also failed to provide a three day and seven day “right to cancel” upon receipt of written a agreement.Desired Settlement: I request a billing adjustment indicating that [redacted] has been paid in full as per the amount of $1070.00 for that permit as final payment due on any balance [redacted] claims is due to him or his company. The total sum he has received from me to date is $2070.00 because he previously received and cashed a check in the sum of 1000.00 on April 19, 2014. Accordingly, the $2070.00 finalizes any amounts due to [redacted] per the Contractors State License Board rules and regulations. [redacted] is further noticed that your harassment, coercion, threats and intimidation to extort funds in addition to your violation of the laws and regulation, failing to issue written contract with itemize charges will cease immediately. Any further harassment, coercion, threats and intimidation to extort funds, from Mr[redacted] will result in pursuing a complaint to the Contractors State License Board for violation of Assembly Bill 316.
