Complaint: [redacted] I am rejecting this response because: The response simply brushes off the complaint and does not provide my desired outcomeThe paragraph they quoted from Section of the agreement stated, "...so long as such temporary closures are reasonable." Closing for FULL days and half-days, out of a month, is NOT reasonable Also, there are NO other locations in the mile radius.Section (Buyer's Rights) of the agreement states, "As a buyer, you have the following rightsPlanet Fitness will: (A) Refund you the pro-rata cost of any unused services, within days after request therefore, if: (2) "...the services provided by Planet Fitness are materially impaired." In this case, the services were materially impaired for full days and half-days.The last paragraph of Section also allows for disputes between a member and the club to be decided by arbitration in accordance with the rules of the American Arbitration Association.I still request my original desired outcome for a refund of $(the appropriate pro-rated amount) Regards, [redacted]
Good Afternoon,Response to complaint Member *** *** - Ocean Spring LocationAttached please find a copy of Mr ***'s agreementon Page Two Number Paragraph 2 it states the following:We were closed for major improvements in the club. Replaced flooring and put in new
equipment and tvsalong with other improvements in locker rooms.Due to constructions restraints we were closed a few days more that we expected. There was appropriate notificationto all members via e-mails and phone calls. We apologize for the inconvenience to Mr *** and all other membersat this location. I am rejecting this response because: The response simply brushes off the complaint and does not provide my desired outcome. The paragraph they quoted from Section 5 of the agreement stated, "...so long as such temporary closures are reasonable." Closing for 21 FULL days and 2 half-days, out of a month, is NOT reasonable. Also, there are NO other locations in the 8 mile radius.Section 7 (Buyer's Rights) of the agreement states, "As a buyer, you have the following rights. Planet Fitness will: (A) Refund you the pro-rata cost of any unused services, within 15 days after request therefore, if: (2) "...the services provided by Planet Fitness are materially impaired." In this case, the services were materially impaired for 21 full days and 2 half-days.The last paragraph of Section 7 also allows for disputes between a member and the club to be decided by arbitration in accordance with the rules of the American Arbitration Association.I still request my original desired outcome for a refund of $15 (the appropriate pro-rated amount).
