I went to Roswell Honda in Roswell, NM to purchase a blue 2017 Honda Civic Type R. I was notified that the car would be delivered to their dealership either Saturday July 1st or 3rd so I went ahead and booked a flight to go and purchase this vehicle on July 1st. Upon my arrival on July 1st to the dealership I was notified that the transport had arrived and that the car was in the maintenance bay where they had removed the spacers for the suspension while being transported. The car never hit the sales lot. I purchased it from the mechanics bay. The car was advertised for sale on the window sticker that was attached to the interior window of the car for $34,775. No other papers or advertising was a attached to the car anywhere.
While going to sign the paperwork I noticed that the price had jumped up by $10,905. When I questioned the price to the finance manager named Joe he told me that the GM had put this package together and that the price was not going to be changed. After purchasing the car and upon arriving home and reviewing the paper work I noticed that the apparent $10,905 increase was not advertised or itemized in writing anywhere. For example, everything else on the purchase agreement contract was clearly marked with a line item description that had a price associated with each line item. This $10,905 increase (in comparison to the window sticker) was not itemized nor explained anywhere on any of my paperwork in writing. I think that I was taken advantage of and pressured in to accepting this higher price unfairly without being notified in writing. The finance manager asked me sign the New Mexico Bill of Sale that was not filled in all the way and he told me that his assistant would fill in later. I was also required to sign a blank Nevada Bill of Sale that made me very uncomfortable that he said he would fill out later if needed. This made me think that I was just signing a blank check.
I want to keep the car but I want a $10,905 price reduction as advertised on the window sticker. My fear is that the dealership will scramble to falsify documents or advertising that was not present on the day of the sale to justify this price increase. I'm especially nervous because they had me sign both a New Mexico and Nevada Bill of Sale documents that were blank or missing information that Roswell Honda could potentially be completed with terms, conditions, advertising, or price that I did not agree to (or that I was not provided) the day I bought the car. I'm just going off of everything that I have in writing that I signed and the window sticker from the day of purchase.
While doing my research, I have discovered many dealerships that do mark up their cars by writing directly on the window sticker. In my case at Roswell Honda, there wasn't any advertised markup on the window sticker and there wasn't any itemized description explaining a markup or price increase on the purchase agreement contract.
Everything is itemized in writing on the yellow contract and pink buyers order EXCEPT for the price increase. On the yellow contract they even itemized the Honda Care, Gap Insurance etc. On the Service contract (Pink) they even added in the 'other' section for Service Contract/ Gap Ins $4,933.00. I have included and example from another dealership where there was a $20,000 price increase for 'Limited Availability'. Because the price increase was not advertised in writing on the window sticker, and it wasn't itemized and explained on the either this pink or yellow contract, I feel like I shouldn't have to pay for it. If there is a price increase I think it should be advertised and explained for in writing ESPECIALLY on the contracts--and it wasn't.
To Whom It May Concern: In regards to Revdex.com Complaint ID: *** On June 30, 2017 at approximately 1:15 pm, Mr. *** called into our dealership and spoke with sales consultant Gabriel O regarding the availability and price of a 2017 Honda Civic Type R. The 2017 Honda Civic Type R is an incredibly rare vehicle with limited production. In fact, most Honda dealers in the country are only receiving one for the entire year. They are numbered and availability is very limited. Mr. was notified on this phone call that our Type R was in transit and should be on the ground within the following few days. Mr. then asked the price of the vehicle which was disclosed over a recorded phone line. Mr. agreed on the price over the recorded phone line and then offered his credit card information to secure this vehicle for himself. Mr. knew the price of the vehicle before he offered his credit card to secure, before he made travel arrangements and before he signed paperwork in the dealership. On July 1st, 2017 Mr. was notified that the vehicle had arrived. He notified Mr. O that he had made travel arrangements and would in fact be at the dealership to take delivery later that day. Upon arrival, Mr. inspected and test drove the vehicle prior to signing paperwork. While in the finance office, Mr. was afforded the opportunity to review all paperwork before signing and taking delivery of the vehicle. As Mr. states in his complaint, he brought up the price to the Finance Manager prior to signing the paperwork and he was told that due to limited availability, the price would not be changed. Mr. proceeded to sign and complete all paperwork and take delivery of his new vehicle.The factory MSRP is a 'manufactures suggested retail price'. This is in no way considered a price limit. Mr. was notified of the price via a recorded phone line prior to committing to the purchase and making travel arrangements. Upon arrival, Mr. was made aware again as stated in his complaint letter, that the price would not be changed prior to signing all paperwork. Mr. was then afforded the oppportunity to review all paperwork prior to signing and proceeded to sign and complete all paperwork. At any point during this process, if Mr. was unhappy or unsatisfied with the price of the vehicle, he could have simply not purchased the vehicle. Mr. had the opportunity multiple times throughout the sales process to simply leave and not complete the deal.If Mr. would like to discuss further or has any additional questions he can contact me directly.Respectfully,Ricky GGeneral Manager

I am rejecting this response because:
Although you have my conversation on a recorded line, does that exempt you from providing me an itemized description in writing of the product you sold me? If that was the case then there would be no need for a written contract and you could just sell cars on someone's 'word' and a handshake. I appreciate your wanting me to call you directly; however, I don't think you would just offer to cut me a check for the $10,000 that I am requesting back. If that is your intention then feel free to give me a call. I have just escalated this complaint to *** directly Reference # *** and *** gave me the phone number for the National Center for Dispute Settlement where I can seek arbitration. That will be my next avenue or the Attorney General's office, or both.
I was not provided anything in writing as to what justifies a $10,000 price increase on the vehicle I bought; therefore, the contract seems invalid to me. No line item, no description, NOTHING. Is this a common practice at your dealership to verbally increase the price of your vehicles over the phone and not provide any explanation in writing on the purchase agreement? If you want to make a deal or settle with me then please do so. Otherwise I'll just keep escalating this complaint going until there is a resolution.
