Mr. [redacted] was paid $1600 for a repair job that was never completed and his negligence led to the vandalism of my car while in his care.I delivered my 1997 Four Runner to Mr. [redacted] in August of 2013. He agreed to remove the V6 engine, rebuild the engine, replace the rod bearings, main bearings, piston rings and all seals, recondition both cylinder heads with valves and seals, and resurface the crankshaft. Upon completion, he also agreed to provide a warranty on his work to last for one year or 12,000 miles. I was very patient with Mr. [redacted], but he took advantage of my patience, notifying me after five months that his repair was complete. Once I received my car back on January 10, 2014, I was shocked to discover damage to my vehicle and was told that my car had been vandalized when Mr. [redacted] failed to lock the door of my vehicle while under his care, custody and control. He agreed to pay to replace the radio system. Additionally, I discovered my car was not driveable to the extent that I had to seek asssistance from [redacted] and [redacted] just to get to work. I notified Mr. [redacted] that there was a problem with his repair per my discussions with the mechanics at [redacted] and [redacted] Mr. [redacted] told me that he would retrieve my car by wrecker service, but he failed to fulfill that promise. After several attempts to allow Mr. [redacted] to correct the problems with my Four Runner, I decided to take my car to [redacted] for repair. Once the mechanics at [redacted] looked at the vehicle, they pointed out the poor workmanship performed on the engine and noted various instances where Mr. [redacted]'s repair had worsened the condition of my car, including the fact that he improperly attached the hood of my car such that I was at risk of the hood flying off had the car reached high speeds on the road. I have demanded the total $1600 payment back from Mr. [redacted]. I have also demanded an additional $304 to be paid to me for the replacement of my audio system. To date, Mr. [redacted] has not complied or responded to my demand. I have paid more than double the amount I paid Mr. [redacted] to try and correct the problems that were caused by trusting Mr. [redacted] with the repair of my vehicle. I wish to have my money reimbursed to me as soon as possible as I was not provided the services for which that money was paid. I also expect Mr. [redacted] to replace the audio system. Desired SettlementI wish to be paid the $1600 that I paid for repairs and the $304 for an audio system that was comparable to the system that was vandalized under Mr. [redacted]'s care custody and control.I plan to seek every opportunity under the law to be reimbursed for the repair costs and the vandalism to my car.
