Review: I received an oil delivery from Romanelli and son who I was no longer in contract with. They had been notified by my new company in writing by way of a post card. Before signing with Slomin's I called Romanelli and son to verifiy when my contract was up. I signed with Slomin's in May. In December,7 months after my contract expired,Romanelli and son delivers oil. Of course, they charged me a much higher price. I call to tell them we are no longer in contract and they should not have made that delivery and they tell me to bad you have to pay it anyway. They also made other statements that were completely untrue that's why I felt I could not let this rest. I called again to see if they would adjust their price because it was due to no fault of my own and was told no. The two times I spoke with someone they made false statements which leads me to believe they've done this before. Romanelli charged 4.0990 Slomin's contract price 3.2990Desired Settlement: I want this on record in case it happens to another consumer even if I don't receive any money back. The fact that I verified the information and was met with a nasty attitude. I feel a reputable company wouldn't need to mask their mistake with untruths by their customer service representative.

Response:
Dear [redacted]:
Please accept this letter in response to [redacted]’s complaint.
[redacted] had signed with Romanelli & Son, Inc. on 12/**/07 for automatic deliveries, and we have been delivering to her on an automatic basis when due since she signed up with us.
On 10/**/12, [redacted] accepted an on line price cap of $3.999 per gallon thru 5/**/13. Had she read the price agreement, she would have seen the paragraph that states, “The Capped Price will expire at the end of the Pricing Period without further notification, and all subsequent deliveries will continue automatically at Romanelli & Son Inc.’s prevailing retail price in effect at the time of delivery, until a new Price Protection Agreement is secured by the Customer. Customer is responsible for contacting Romanelli & Son, Inc. upon expiration of this agreement in order to secure new Price Protection.”
On 12/**/13 [redacted] called screaming because we had made a delivery to her and she said that her account with Romanelli was cancelled back in May. She stated that her new heating oil supplier was to notify us of her cancellation. Again, had [redacted] read her signed Price Agreement contract it states, “You may cancel your account at any time on 30 days written notice…” Romanelli & Son did not receive a written request to cancel her account.
Please understand that Romanelli & Son would never deliver to a customer who no longer wants to do business with us. Unless a customer requests a delivery stop, we must continue to deliver. Certain customers shop regularly, but we cannot assume all customers that shop are cancelling, if so, they would run out of oil and be upset.
With regard to [redacted]’s last delivery received from Romanelli & Son on 12/**/13, we delivered 73 gallons priced at the daily market rate per gallon on that day and totaled $299.23. We received payment in full from [redacted] and have terminated her account. Romanelli & Son, Inc. considers this matter closed and wish [redacted] well with her new heating oil company.
If I can be of further assistance, please do not hesitate to call me.
Sincerely,
Romanelli & Son, Inc.
