I am in receipt of your letter dated June 2, 2015 regarding the above referenced case. Pursuant to your request, I am submitting this reply to the complaint. Our office has been retained to collect on a valid judgment...
that is in place against the complainant. In an attempt to collect on this judgment, our office mailed the complainant a notice of intent to garnish earnings on January 12, 2015. The letter requested that the complainant provide documentation supporting her claim together with the completed exemption form if the complainant claimed that she was exempt from garnishment. No response was received from the complainant. A garnishment was sent to the complainant and her employer on January 30, 2015. On February 16, 2015, our office received the completed exemption form from the complainant, with no documentation supporting her claim. On April 17, 2015, our office sent the complainant a letter again requesting documentation supporting her claimed exemption. On May 13, 2015, and May 21, 2015 the complainant wrote to inform our office that she was exempt, without providing any documentation supporting her claim. On May 27, 2015 our office received documentation from the complainant supporting her claim. Upon receipt of this documentation, our office sent a letter to the complainant's employer on May 29, 2015 terminating the garnishment against the complainant and requesting that the employer release from the garnishment any funds withheld. No funds have been received by our office as a result of the January 12, 2015 garnishment, and therefore our office has no funds to refund to the complainant as she requests.
Sincerely,
RODENBURG LAW FIRM
