This took place at our Cathedral City location, not the Palm Springs location. We do not do any watch repair at any of our stores. A separate third party business runs a jewelry repair service in the same building as our Cathedral City...

business. That third party business does not accept any credit or debit card payments - cash or check only. This consumer approached our business to use his card to get cash. We thus charged him $3.00 for using us for ATM services. We described other locations around our business for the consumer to go so they might not have to pay the fee but the consumer denied using any other options. The jewelry repair business accepts cash as well as checks and the alternate ATM was only 1 block away, but the consumer refused to use it. We gave him advance notice of the fee and again mentioned alternate options for him to use.The consumer was well aware of the charges before using his card and still decided to do so.

I was told if I use a credit card it will be a charge of $3.00. I was not made aware that they were going to give me actual cash that I had to walk back to the Watch Repair counter. In the State of California - a fee for using a credit card vs cash is not allowed. Again if had known he was going to hand me actual cash I would have gone to an alternative source I was not made aware of a nearby ATM.
