A car was bought at auction on our behalf through Robertson Motors (1996), and despite having paid for a safety we have discovered that the car was not properly safetied - confirmed by the factory dealership- which has resulted in $3000 worth of repairs thus far. $1000 of which was done through a Robertson Motors(1996) which included the breaks and now after less than 60days the breaks are already starting to squeal. We even identified a clicking on the front end upon receipt of the vehicle which we were assured was not a safety issue; it end up that it was.
Additonally, despite our agreement Mr Robertson failed to provide us documentation that we had asked for, even the Carproof was a struggle to get. After receiving the car we did some more digging in to the auction results and found that Robertson Motors (1996) inflated the auction price which was not disclosed and we were additionally charged a flat rate commission based on the fact that we were only reimbursing the cost of the car from auction.

Refund Reimbursement of the difference between the inflated price and actual price along which reimbursement of the cost of repairs that should have been caught on the safety.
There is no satisfying ***. I have worked with him, spoke with him, refunded him close to $400. I sold him the car but an outside shop did the safety. He is after me to pay for/fix every problem he has associated with the car and the safety. I will admit he has had some issues with the repair shop but safety standards certificate issues are between the shop and him, not me. As far as pricing goes he willingly paid what I told him the cost would be. Some people are out for blood/vengeance/whatever and will never be satisfied because they felt they were wronged.

The repair issues outlined in my original statement were to provide context as to how we ended up at this point. The issue at hand is not about "blood/vengeance" -as Mr. Robertson put it - but fair pricing and due diligence. I am not asking for all of the recent repairs to be reimbursed, as that would be unreasonable, only that which should have been resolved on the safety. As well, how as the consumer, are we to resolve our issues with the repair shop or safety centre when Mr. Robertson/ Robertson Motors (1996) took the vehicle to these facilities prior to the sale? We have not been provided receipts or proof of what work was completed other than his word. Additionally, the repair shop and Robertson Motors (1996) both share the same business address.
That being said, the main reason for all of this is the falsely listed auction sale price. Mr. Robertson knowingly inflated the Auction sale price, originally $9800 vs the $10500 he reported to us, and an Auction fee of $285 vs $385, a difference of $904 (tax included). A delivery fee of $85 dollars was also charged of which there is no evidence or receipt. All of this is on top of the $1000 flat rate commission. We had asked for proof of sale prior to purchase but never received one until we investigated on our own. As far as willingly paid the price mentioned, that as well is not true; reference the email documents provided. We had given Mr. Robertson a top dollar budget to work within, of which he was over by nearly $1000. Had Mr. Robertson used honest pricing to begin with, we would not have been over budget, Mr. Robertson would still have made a profit from his flat rate commission and we would likely not be in the position we are in now.
