On 4/30/19, I hit an pothole on the Indiana Tollway. This pothole could not be seen due to the wet road conditions. I had damage to my vehicle. I filed a claim with the Indiana Tollway. The Tollway claimed they were not responsible for the damage since their services were subcontracted. Subcontractor Rieth-Riley responded on 6/17/19 claiming that they are not responsible for potholes, that it’s part of a road condition, is The pothole cost me an excess of 350.00 and 3 hours of my time to repair.l
The pothole encountered was not a result of work performed by Rieth-Riley. The existing condition of the road was poor and the continue freeze/thaw cycle coupled with heavy traffic flow caused the road to continue to deteriorate. Due to the poor road condition on the Toll Road, Rieth-Riley had a patroller continuously monitor the road 24 hours a day, 7 days per week. When the patroller identified a pothole or other hazard, the patroller organized any needed traffic control, materials, labor, etc. needed to complete repairs within an hour.
I am rejecting this response because:
This company is responsible for the condition of the road, per the Indiana Department of Transportation. The pothole was large enough to cause significant damage, and the company admits its responsibility to maintain all roads and fix all potholes in that specific area. The Illinois side of the highway was paved and smooth - also this incident occurred on April 30th, well outside the frost period in which a pothole would be formed.
The company admits its responsibility to seek, report and patch/repair potholes every hour 24hour a day/7days a week, 365 days a year per its contract with the State of Indiana. A pothole of this size would not of formed over an hour. It is unacceptable that a company such as Riley-Reith would be paid by the State of Indiana to maintain the roadways, but when damage occurs reject any responsibility.
I will escalate my claim if we cannot reach a settlement.
