Review: I signed up for this motorcycle class, and was going to reschedule (and incur a $25 rebooking fee...) but later tried to move it around so that I could attend the class. I could not get back my original appointment but they said I could attend another class at a different location because that spot had not been booked for the weekend yet. Therefore I did not take any spot that would have gone to someone else.
It was a three day course. I attended friday. Saturday was slated for 7:30 but I came at 7:40 due to traffic. They did not let me take the class, which I understand, due me being 10 minutes late. They however, refused to refund me the $295 course fee...
This is outrageous. They did not deliver the service due to me, and also charged me $295 for that undelivered service. It is their discretion if they choose not to deliver a service, but do NOT charge me for that service.
I am filing the compliant in response for the absence of a refund that was clearly owed to me. I never agreed to forfeit my fees in event of lateness (10 minutes...)Desired Settlement: I would like a full refund of the $295 that is due to me.

We are a non-profit organization that runs an instructional
course on how to ride motorcycles. If
the student passes the course and has a valid New Jersey driver license, the
state MVC waives the written and road test since we are a state approved
program.
On September 18 at 10:41am, [redacted] registered for a
Basic RiderCourse scheduled for September 27-29th at our Piscataway location.
During the online registration the student has to accept our 2 sets of terms
and conditions before the system will allow them to register and pay for a
course. [redacted] registered and paid for her course and she also accepted both
sets of terms and conditions. Accepting the terms and conditions acts as your
signature agreeing to them.
On September 26, 2013, [redacted] called the office and said she
could not make her scheduled class because “something came up”. As stated in our Terms and Conditions, on our
website and all the paperwork the student receives, we have a 10 business day rescheduling/cancellation
policy. We told [redacted] that we would have
to find someone to fill her spot and once we did, she could reschedule for a
$25 rescheduling fee, which was also mentioned in all of our paperwork. We worked diligently on [redacted]’s spot so that
she would not lose her money and filled it with another student. As we were finalizing the other student’s
paperwork, [redacted] called into the office saying she wanted her spot back because
she did not want to pay the $25 rescheduling fee. We told her that it was filled already but
offered another spot at one of our other locations, Lincroft; no charge since
it was the same weekend she was originally registered for. She said she wanted to take the Lincroft spot
because she changed her schedule and was now available. We instructed her that she cannot be late
under no circumstances or she could lose her spot and money. She said she would be there on time because
she took the day off from work and had plenty of time to get there.
On the first night, Friday, September 27th, [redacted] showed up
late. Since they were in the classroom
and not too far ahead, the RiderCoaches allowed her in the class and caught her
up on the classroom portion. The RiderCoaches
warned [redacted] that she could not be late again and if she was she could be
removed from the class and lose her money.
On Saturday, September 28th, [redacted] showed up approximately 30
minutes late. The class had already
completed exercises on the motorcycle and was too far ahead to catch [redacted]
up. She was not accepted into the class.
On Monday, September 30th, [redacted] emailed the RENJ
Office in regards to her being late and asking to be rescheduled. In the interest of motorcycle safety, the
Board of Directors allowed [redacted] to reschedule with a $50 rescheduling
fee. She is rescheduled for October
18-20th at our Piscataway location.
She was warned again that she cannot be late or she will lose her spot
and money.
