Dear Ms***: Regarding the above complaint, she called the Kirby Comain office and I spoke to them afterwardsTheY informed me that she had no standing under the Federal and Texas law mandating a three (3) business day cancellation period by her own admission of being late to send itIn her complaint, she states that she will not be finished with her foot problems until December, In her original request to us mailed on November, 2016, in an official FAA envelope, she stated that her recovery would be up on NovemberShe did give us the name of a person she says is her doctor, but since she is "versed in using Small Claims Court (see attached)," she shoulld be aware that medical providers must observe HIPPA, we cannot contact himAll other matters aside, we will not be honoring her request to take the Kirby back and she is responsible for the full amount financed, plus finance charges to which she agreedSincerely, [redacted]
We fully understand the customer wants to cancel her contract, but, as she noted in her, initial request to us and in her complaint to you, she also wants us to ignore state and federally mandated law to do so We regret to inform her that we will not be doing that due to the precedent that would set The law is there for her protection as well as oursThank you for allowing us this opportunity to resolve the matter
