The business came in and met with BBB, and left the following response. Prior to September I tried to reach Ms. [redacted] for the remaining $1000.00 that was due. Ms. [redacted] reached out to me on 9/3/2016 with concerns regarding her roof. After she tried to contact Jack the... sub-contractor. She sent me a text message on September 3 stating that she reported her complaints to Jack, who said he would come back the next day but never showed up to do the clean- up. I responded to her text message on September 6 after trying to reach Ms. [redacted] by phone. I explained to her in that text she should have complained to me since the contract was through me. I explained that everything was easily fixed and does not constitute the consumer not paying the remaining $1000.00. I told her that I believed we could find a resolution. Ms. [redacted] responded with the roof should have been installed properly and properly installed flashing, that there were exposed nails, untrimmed shingles, nails and debris on roof and in bushes also in the lawn and gutters, trash left in her yard, and equipment was left. Also, she would have had to pay the satellite company to reattach the satellite to her home. I explained to Ms. [redacted] that I could take care of everything and use a different crew. I also gave Ms. [redacted] my address to send me an invoice for repairs that she wanted to have done. Ms. [redacted] still has not sent me the invoice. As stated previously, I will be happy to come out and have the flashing, nail pops, trimming of shingles, the minor repairs that I suggested to the consumer 6 months ago. However, since the roof has been installed there have been two windstorms, my 10-year warranty does not cover new wind damage. All work was done in accordance with the insurance work scope.

I am rejecting this response because:This response is incorrect. The gutters were functioning at the start of the project and were in good shape at the start of the project. I was not advised to replace them, nor did they need replaced. The crew on site damaged the gutters while doing the work on the roof and other contracted work. There were no side deals concerning gutters as putting gutters back on house as removed was expectation. Do not even know what contractor is talking about when he says side deal was done. Existing gutters were smashed by crew due to negligence in work and damaged beyond working condition to replace in same condition they were removed. I have emails and text history and pictures sent to contractor outlining these issues and they were never disputed until now that contractor was unable to repair the damage due to their negligence

The gutters were not properly functioning before the project started.  They were over 20 years old and the customer was advised to replace them.  The consumer was told that the gutters were not in the contract.  Further, out of kindness and not obligation, the business owner and crew...

did try to fix the gutters, as the customer stated.  The customer subcontracted the business' employees directly.  It was a side deal with the employees.  The business did not have a contract for the work.  The business is not responsible for any reimbursement for the gutters and is prepared for litigation.  Overall, the in every aspect of the job, the customer tried to extend the parameters of the contract and is trying to get something for nothing.  He went against the business' advise to replace the gutters.
