Thank you for letting us know about the issues that you are having with Crescent Bank. Before responding to your complaint, I wanted to better understand the history of your account. I reviewed our call history for your account, because it would be quite unusual for us to call
the co-borrower before calling the borrower. I found that we tried to reach your son times from January 17, to June 23, 2016. Unfortunately, he did not answer or return any of those calls. The call history shows that we called you seven times, from February 24, through June 23, and only one of those calls was not precipitated by a call to your son. We do appreciate you taking our phone calls and calling us back. That has been very helpful in keeping the account on track However, we certainly understand that you do not want to be called by us and we placed a “do not call” flag on your phone numbers on June 23, 2016.Your June 22nd payment, submitted through our telephone payment system, was processed and posted on June 23, Our system does not advance the next due date until payments post and it did not post until after we called you. I can understand your frustration because you had already authorized a payment but still got a call from us I do apologize for that and would like to thank you for bringing this to our attention. concerning her account with Crescent Bank (Crescent) Ms*** signed a contract on 8/29/for the purchase of a Honda Civic. The contract included the required Federal Truth in Lending Disclosures that clearly stated the terms of the contract. The contract also provides for late charges equal to % of each installment if a payment is not received within days after it is due. Ms***’s monthly scheduled payments are $and are due on the 13th of each month. The charge for late payments is $Late charges do not accrue interest Crescent processes payments daily, all payments are posted as of the date received. Payments are never held from posting unless they cannot be identified There is no indication in Ms***’s file that Crescent received unidentified payments on her account. Payments were posted when they were received. Crescent calls customers when their payments are past due. Sincerely,Compliance Department

You'll note the consumer was severely past due (actually past the point we normally repossess the vehicle) and has breached his contract on numerous occasions.

***’s complaint regarding an account with Crescent Bank (Crescent). At the time of repossession Ms***’s July and August payments were past due and phone calls made to her were not returned. The contract Ms*** signed for the purchase of the Hyundai clearly states payments of $are due on the 13th day of each month. It also states if there is a default on the contract (any payment due that is not received within days of the due date) Crescent may take possession of the vehicle
Payments made online are not recognized until processedEntering a payment on line does not automatically post to an account; the funds have to be verified by the issuing bank. If Ms*** had returned our calls and advised us she was making a payment online the repossession assignment would have been put on holdThe repossession fees are allowed under the contract and will not be reimbursed.
The contract is a legal obligation and Crescent will not release Ms*** from her obligation. Crescent reports customer information to the credit reporting agencies and will continue to report complete and accurate information concerning Ms***’s account

We apologize for the bad experience that *** *** had with our customer service department and for the problems with her deposit account and ACH. In reviewing our account notes and discussing the ACH with several employees, we believe the following to have occurred. In January
we received an ACH authorization to debit the monthly payment from your account ending in We established that ACH auto-debit at that time. We do require cancellations to be submitted in writing, to ensure that you, the customer, authorized the cancellation. ACH auto-debits must be cancelled two business days before they are set to cancel and, unfortunately, we did not receive your cancellation in time to stop the June 3, auto-debit. We do not have a record of your cancellation notice, but want to correct the problems that you had related to your ACH payments. Our Call Center Manager reached out to *** *** to gather information about the complaint and to determine what steps we could take to resolve any NSF issues that we may have caused. Mrs* *** returned his call today, and will be sending him some documents to assist us in resolving this complaint to her satisfaction. Thank you for contact us regarding the problems you have had with your vehicle.  I researched your account to better understand its history.  Our notes indicate that on December 31, 2015, the vehicle would not start, resulting in your request that Mazda Roadside Towing bring it to Mazda...

for repairs.  The towing company was not able to deliver the vehicle to Mazda because there was no “night drop”.  You never received a call from Mazda, to let you know that they did not receive your vehicle and then the towing company assessed a storage fee for storing the vehicle.  I am sorry that you have had such a hard time with Mazda Roadside getting your vehicle to its intended destination.  Unfortunately, we are not in a position to help you with the towing company or Mazda.  We fulfilled your request to voluntarily surrender the car, retrieved it and sold it at auction.  There was a deficiency balance because the amount owed was more than the funds received at auction.  Our agreement with the Credit Reporting Agencies requires us to report accurately and, at this point, your account remains deficient.  If you wish to pay off the account, please contact us, toll-free, at ###-###-####.  We would be pleased to report your balance as paid in full, once you pay the outstanding balance.

with Crescent Bank (Crescent).  The contract is based on the simple interest method of calculating interest. The amount of $5.22 that was quoted to Ms. [redacted] was the per diem interest rate, not a late charge. Late charges are assessed according to the provision in the contract.  Crescent’s policy is to not allow a payment date change if the contract allowed for 45 days from the contract date to the first payment date. Independent Dealers Advantage, LLC (IDA) was the original owner of the contract. It is sitting out in front of the body shop. My insurance company's adjuster wrote the car up totaled last Friday March 25th 2016 so the car will paid in full by grange  insurance

As we all know, the primary, my son, lives with me. He
allowed me to view his cellphone history and in the time period mentioned, he
has not received one phone call from them. In fact, during the entire life of
the loan to date, he has never received a call.
During the same period, I have received way more than 7
phone calls from them. In fact, there have been at least 5 to 7 on average per
month.  They are either telling a complete and blatant lie; their records
are screwed up to the point where they have the wrong number listed for him.
The wrong number thing is hard to believe since he has had the same number
since before he bought the car for which the loan is for and has called them a
few times from his phone. SO as I see it, something is wrong on their end which
needs to be corrected. It was never my intention to be put on a no call list.
In fact, I would want to be called as a last resort if my son for some reason
has not made his payment. What I do not want is this company to lie to me about
the number of calls made to me. 
In addition to what I have stated before, I want for them
to contact me via email at [redacted] or I may be called at the
number they have listed for me but after 12:00 noon EDT as I work the night
shift. It is my belief that they have the wrong number for my son. I would like
to know what number they have listed for him. I also want a formal apology from
them with regards to this matter. They have not conducted themselves in a
professional manner nor have they even tried to insure they have the correct
numbers for all on the account.

assigned to Independent Dealers Advantage (IDA). It was then assigned to Crescent Bank (Crescent) on 12/30/2008. On 7/8/2011 an impound notice was received stating the 2006 Chevrolet had been abandoned at a dealership; the vehicle was then repossessed and sold. The proceeds of the sale of the vehicle were applied to the principal balance of the account but it was not enough to pay off the entire amount due. The deficiency balance is still due. Crescent has not received any payments since the sale. Interest has been accruing at the contractual rate since July 2011. This is provided for in the contract. The contract does not end after the sale of the vehicle if the balance is not paid in full. The contract allows for interest to continue accruing until the loan is paid in full. This is a valid debt; Crescent would be happy to work with Ms. [redacted] to help her resolve this issue.

spoken with Mr. [redacted] or the co-signer on the loan since 6/24/2015.  Crescent tries to work with our customers when they have financial difficulties.  We tried to contact Mr. [redacted] and the co-signer many times over the past 5 months but messages we left were not returned.  The account is now 3 months past due.  If Mr. [redacted] calls our office a representative will review the account to determine what we may be able to do to help him.
