Regrettably, the Company had previously changed the address of record to Ms. [redacted]'s address when we received return mail from our annuity contract holder. Thus, due to this inadvertent error, Ms. [redacted] has been receiving correspondence from the Company in error. We offer or sincere apology to Ms. [redacted] regarding the frustration and inconvenience this matter has caused her.
Subsequent to her complaint to the Revdex.com, one of our service representatives had an additional conversation with Ms. [redacted], who kindly provided our office with enough information for us to ascertain that that she is not our client. I am rejecting this response because:The company stated they assumed my father's death preceded the death of my grandfather. No where in the court documents does it mention anything about what date it was presumed my father had died. All the court documents state is my father was declared dead on the date the judge signed the paper and declared me the heir. This was roughly eleven months after the death of my grandfather. The company can make all of the assumptions they wish, but their assumptions are not based on proof. The only proof provided are those of the legal court documents in which my father was declared dead AFTER the death of my grandfather.

This is in response to #[redacted].   We have reviewed the policy and claim file in question and have determined that the claim was appropriately paid.   The beneficiary designation under the policy states:   “(name redacted), wife of applicant if living; otherwise the children...

born of the marriage of, or adopted by, the applicant and said wife, or the survivors.”   A sworn affidavit of surviving children was initially provided and included the name of the complainant’s father.  Subsequently court documents were provided by the complainant indicating his father has been missing since 1996. On November 3, 2015 an application to Determine Heirship due to presumed death was filed; which was granted March 4, 2016.      Given the period of time a person must be missing before being declared deceased, his death would be presumed as predeceased to the Insured’s death of March 29, 2015.   As a result, in accordance with the policy’s beneficiary designation, the proceeds which would have been payable to the complaint’s father if he were living, was distributed among the surviving children.   We appreciate the opportunity to respond.

This is in response to the additional comments on January 2, 2017 regarding #[redacted].   It is the Company’s position that the claim proceeds relating to this referenced matter have been appropriately disbursed to the surviving beneficiaries of the insured.  As explained in more detail below the Company reaffirms its determination that the complainant’s father’s death is presumed as predeceased to the Insured’s death in March 2015.     The Company received a copy of the Judgment Declaring Heirship – Estate of (redacted) together with a Statement of Evidence, filed November 3, 2015 and signed by a Judge on March 4, 2016. The Statement of Evidence indicates that upon completion of an investigation by the attorney ad litem, “she was satisfied that the Decedent has not been heard from since 2001”.  Under applicable Texas law, an individual is presumed dead if absent for seven years or longer. (See Tex. Civ. Prac. & Rem. Code § 133.001 and Tex. Prop. Code § 71.002)   Given the Company’s interpretation of applicable law, and taken into consideration with the fact that the complainant’s father has been missing since 1996 per the complainant, and/or has not been seen since at least 2001 per the attorney ad litem, the complainant’s father is presumed to have predeceased the insured and the full death benefit has been distributed to the remaining surviving beneficiaries.    There are no further benefits payable under this life insurance policy and the Company considers its obligations under the policy satisfied.
