While the care my mother received from the employees at Red Mountain Reflections was wonderful, the protection of my mother by the owner was not.
As Power of Attorney for my mother, I specifically told the owner that the only people that could take my mother off property (other than me) was my brother unless I gave permission at that moment. The owner still allowed my sister to take my mother off property without my permission many times without my specific permission. He even allowed her to take my mother off property overnight wherein my mother did not have her medications for more than 24 hours (one medication was for dementia).
The required paperwork from my Mother's primary care physician prior to my mother moving in at Red Mountain Reflections regarding her health stated (twice) that my mother has dementia. This paperwork had to be reviewed by medical personnel at Red Mountain Reflections on the day my mother moved in...and the RN that reviewed was it was the owner's mother.
When I received Temporary Guardianship of my mother, I again reiterated to the owner that he was not to allow my sister to take my mother off property...and again, he allowed it saying "I never meant for this facility to be a prison and your mother said she wanted to go with your sister". Interesting note...the medical paperwork said my mother has dementia so therefore, she cannot make reliable decisions for herself.
The owner of Red Mountain Reflections did not uphold any verbal or written restrictions by me as Power of Attorney and/or Guardian until I gave him an Order from the Superior Court Judge specifically stating that my sister could not remove my mother from the property.
Yes, my sister did take a document (from the internet) to the owner stating she was the new Power of Attorney but if he had actually reviewed it, he would have noticed that it was invalid as the notary that notarized the document also signed as a witness to my Mother's signature. Yes, that means the notary notarized her own signature...looks pretty improper to me.
If you are needing a residential place for your loved one and need legal paperwork to be upheld by the facility owner, keep looking. If he wouldn't uphold it for me, don't count on it for you.
And yes, my mother has been relocated to a place that upholds my Power of Attorney and Guardianship.
