why the account was referred to the San Francisco Department of the Environment (SFE). SFE sends warning letters that direct customers to comply with the SF solid waste and recycling ordinance. They follow up with site visits after sending the letters.
From January 1, 2015, to September 30, 2015, this account had more than 20 documented reports of contamination. It was not until after the warning letter was sent and a site visit conducted, any improvement was seen with the contamination issue. Prior to this, and as far back as November of 2013, the carts had been noted as being contaminated.
With respect to the distance charge issue, Recology did admit to erroneously applying special distance charges to the account in 2013, not 2014. However, those charges were credited back to the account on 7/25/2013.
We do recognize that errors do occur and the challenges owners and property managers face trying to get tenants to comply with the solid waste and recycling ordinance in San Francisco. However, it's their responsibility to ensure that the tenants do comply. In this case, we are aware that the contamination issue has improved greatly. For that reason, we are willing to credit back half of the 2015 contamination charges, if Mr. [redacted] agrees. We will also continue to tag the carts when contaminated and will charge if it becomes an issue again.
