refusal to provide refund due to extenuating circumstances.
refusal to refund due to son and husband having compromised immune systems. one with type 1 diatbetes and 1 with Eosinophilic Esophagitis. Neither can swim in pool or go near ocean with the outbreak of flesh eating bacteria. email send on july 12 which was 29 days till arrival instead the contractural 30 days.
my refund for $988. they can keep the $50 that is in the contract for 30 days prior cancellations

Consumer made reservation online, and booked on June 17 for an August 10th check in. Reservations run from Saturday to Saturday, there is no open office on Sunday but there is a lock box to retrieve keys. According to our ribbon chart, it appears they checked in on August 10th. There are no refunds for cancellations within 30 days of the reservation date.
This is a timeshare which is not run like a hotel, the terms state no cancellations once they reach within 30 days prior to arrival mark. As part of our contractual obligation to the owner of the unit, the owner is guaranteed their money once it reaches 30 days. We do not receive the payment for the reservation, the owner of the unit receives the payment. In the timeshare industry it is common for 30 or 45 day cancellation policies.
The consumer wanted us to make an exception for the medical conditions they claim to have developed suddenly. It is our understanding that those medical conditions would develop over time, with symptoms that would have required special care to consider even before booking. They were primarily concerned they would not be able to stay near the beach or use the swimming pool because of the flesh eating bacteria outbreak in the news headlines, and were worried these issues would make their medical conditions worse. There are other activities and places of interest in the area that do not involve the beach or swimming pool, such as: visiting the Edison House; visiting the Coconut Point Mall; visiting the Everglades.
Our board members had discussed the flesh eating bacteria: this bacteria exists in all bodies of water, all over the country, alongside other naturally occurring bacteria. The headlines are not reasons to make exceptions for the cancellation policy.
This complaint can now be cancelled. We already spent the week here in order to give our kids a vacation rather than waiting for a response that just came. We know better for future trips.
