This company is pretty much on par with the shady practices you'd find at any predatory "business" such as a pay day loan company. And no, I'm not just a sour car owner who was towed by this company. The problem with this company isn't that they tow people. The problem with this company is their total lack of decency and consideration for the livelihoods they inevitably effect on a daily basis. We're talking blatant price gauging. We're talking about taking not only the most valuable thing a person can own, but also everything in that car regardless as to whether the contents of the car is how that person earns a living. We're taking about refusing to give back said property for over 60 hours. We're talking about denting cars that have been taken into their possession. Yes, I was dumb and parked where I shouldn't have and there should be consequences. But with a minor misdemeanor the punishment needs to fit the crime and this company's actions are far more shady (and arguably illegal). I blocked no throughway or private drive. I blocked no hydrant or anything else that would impeed an emergency situation. What I did was park in an EMPTY parking lot for a few hours and the price I paid was being stranded, damages to my small business, damages to my car and paying an exorbitant amount of money ($300). This company gets you when you're down and twists the knife and they need to change their ways. I'm a respectable business owner on Main Street in Racine and I don't deserve what I got.

On February 20, 2020 I was a victim of what’s called predatory towing . My daughter lives in Racine at the maples apartment on Layard ave . She asked me to come over and get some boxes she had in the back of her car with stuff in them from a friend that left them with her . I pulled my car into the parking lot next to her car and went inside to get her keys from her so I could move them into mine . I was only inside for a little more than 5-10 minutes to say hello and grab her keys , when I came out , my car was gone . One of her neighbors said that it was towed away and the maintenance guy is the one who called . I found the number of the towing company that took my car and called them saying why I was there and demanded my car back. They laughed at me on the phone and said as soon as I pay their fees. I drove over to their business and asked for my car back, they demanded $260. In fees and they demanded cash , they wouldn’t take a credit card. I said they had no right to take my car and the man just laughed again. They said it’s going to cost more every day I don’t pay them because they will charge more fees per day for storage. I feel they just stole my car, I had no choice but to get them the cash they were demanding. I feel I have been cheated. I would like my money refunded to me. I called the Maples apartments manager ( *** ) and they said they would do nothing, I had to talk to the towing company.

According to Transportation statute 34913 they violated the proper sign placement per the statute.

I’m sending you some follow up information that I acquired proving my claimThat they had no right to take my car . 1- Wisconsin state law regarding sign posting ofPrivate Parking lot signs to warn of towing rules , sign placement- trans 319.04 properly posted notice requirements -4 (a) or (b) . 2- photos of the parking lot that my car was towed from showing the lack of signs and the Poor placing of the only sign that is there . ( state law requires the sign be in a conspicuous place for any driver to see - clearly it’s not erected by the driveway but a considerable distance away on the side of the apartment building where it is not possible to read from a car entering the parking lot, also at night there is no lighting on the sign making it impossible for anyone to see it at all and any entering cars headlights WILL NOT shine on the sign to notify anyone of the impounding and towing of their car . ) This is clearly not conspicuous and in violation of the law- they had no legal right to tow anyone’s car. Anything you can do to help me would be appreciated , let me know if you want anything else or what else would be required to prove my claim. Thank you

Regarding the complaint from *** on 02/21/20, we were performing our duties we were contracted to do with The Maples Apartments located on Layard Ave in Racine, WI. I have attached a picture of the signs that can be found throughout the parking lot of this apartment building where the tow occurred, I have also attached the contract that is given to all properties that we oversee. We are contracted with The Maples Apartments to remove any vehicles parked in the lot that do not have a parking permit, parked in front of dumpsters, expired plates, flat tires, etc. When a violation does occur, we contact the manager of the property as well as the local police department to notify them that we are in possession of the vehicles that are taken from the properties we oversee. On February 20, 2020 we were contacted by the maintenance manager of the property to remove the vehicle Mr. was driving. Vehicles can be towed that are in violation regardless of the amount of time it is in the lot. Mr. was in the building longer than 5-10 minutes, that allowed a maintenance manager to call us to remove the vehicle and travel the 15 minutes is takes to get there. As for the cash only, we are a small business that does not take credit cards due to the processing fees. The State does not mandate that we have the option to pay with a credit card or debit card. We treat every customer with respect, we have on many occasions been cussed at, yelled at, and threatened. Mr. was no different, we were just doing the job that we are contracted to do. In response to *** answer, I never cussed at them , yelled at them or threatened anyone. I comely said they had no right to take my car. They laughed at me on the phone and in person when I went to get my car. That hardly qualifies as respectfully treating someone. Perhaps they should ask themselves why in there own words they are on many occasions cussed at , yelled at and threatened. I never did anything like that, never. As far as the signs they claim are posted throughout parking lot, they are not. Attached you will see photos of the lot where my car was taken and what he is claiming is not true. There is one small sign attached to the apartment building in front . That all . There are specific laws and regulations as to how is to be properly posted before they are allowed to legally tow a car . Attached is Wisconsin state Legislatures rules that define manner of posting of parking lots . I obtained this from senator Bob Witch’s office . It clearly states under manner of posting , that all must apply. It states it must be posted at the location of the parked vehicle readily legible- which it is not . There are no signs anywhere in the parking area. The only sign on the property is in front attached to the apartment building where there are no parking spaces , none . It must be conspicuous and readily legible to operators of vehicles driving through that entrance. Which it is NOT . It is a considerable distance from the driveway attached to the apartment building where they post apartment for rent signs . Attached is the photos of the parking lot where they took my car and proof of the absence of signs and it is a clear violation of Wisconsin state statutes regarding towing of vehicles . They had no right to take my car without properly posting the area, I obviously never would have put my car there had I known it was going to be taken. I request that they return the $260. They demanded from me to get my car back considering they did violate the law regarding proper posting notices.

Regarding the response from Mr., we were not in violation of any statutes of the Wisconsin State Legislature. Under Wis. Stats. 349.13 (3m) (2); “properly posted” means there is clearly visible notice that an area is private property and that vehicles that are not authorized to park in this area may be immediately towed. Wis. Stats. 349.13 (d) (1) states that a vehicle may be removed from private property under par. (b) or (c) only by a towing service at the request of the property owner or property owner’s agent, traffic officer, or a parking enforcer. We have signs up right when you pull into the lot of the building which according to Mr. he did see. According to Chapter Trans 319 which Mr. quotes that a notice must be conspicuous and readily legible at the location of the parked vehicle. This means there must be a sign in the lot where the vehicle is parked which is the case. It is not a legal requirement to have individual signs in front of each single parking spot in a lot. If that were the case it would be stated in the legislature as such, but it states it must be clearly visible which it is. We were also contacted by one of the property’s agents regarding the removal of the vehicle. We followed procedure and notified the local authorities of the vehicle being removed from the lot.Not only do we have contracts that are given to property owners and their agents, renters in the building also receive a contract from us stating what is and is not allowed to be parked in the lot. Mr.’s daughter knew he was not allowed to park in the lot, hence why she had a sticker on her vehicle. I have attached a copy of what renters receive when moving into the building, which it clearly states make sure any visitor knows they must park in the marked visitor’s stalls or on the public street. In the case of this building there is no marked visitor’s stalls so Mr. should have parked on the street. Every resident knows the rules of the lot and if they are in violation of what was stated in the notice then the vehicle will get towed. According to state legislature time does not matter, we are able to move a vehicle, in violation, regardless of the amount of time it is in the lot. As for Mr. stating he did not cuss at any of our employees, that is a lie. The receptionist who took his call that day calmly stated how to get the vehicle out of our lot and the cost, he, and I quote, said “You don’t have any fking right to take my car.” He had raised his voice at our receptionist and acted in a very rude manner when he was at our location. In the past we have heard many excuses regarding why people were parked in the lot, and once we don’t believe them that is when we get cussed at, yelled at, and threatened. Again, Mr. was no different. We apologize if our manner came off as rude, it is hard to keep a calm composure when you are being yelled at no matter how many times it has happened, but our employees try their best. We will not be refunding Mr. his money, as we were not in violation of any state statutes and we have signed contracts with the property. I have attached both the Wis Stat 349.13 (3m) and the contracts that were signed by the property manager and the notice that is given to all lessees. It is unfortunate that Mr. had to have his car towed but it is the same for every vehicle that is in violation. We have a contract to fulfill and we were just doing our job.
