REI suggested turning down this tenant prior to the owner signing the lease due to "red Flags" on the applicationAgainst our
recommendation the owner accepted the tenant anyway for lack of applications being submittedAs expected the tenant stopped paying rentREI Liaison suggested initiating eviction after the first rental payment was not receivedIt is the owners prerogative to not initiate eviction until he sees fitWe can not evict until he gives us permissionTo suggest that we held off on the eviction is completely ridiculousWe do not have that authority nor do we conduct the evictionsOur strict processes say that after days of nonpayment we suggest evictionEviction was immediately initiated by the attorney as soon as permission was given to the attorney who then takes overOnce the case has been filed the property management company must cease all communication with the tenantWe are no longer allowed to interfereREI continued to assist Mr*** with correspondence for months free of pay when the tenant filed for bankruptcy further complicating his case and extending the time the tenant was in the propertyAgain there is nothing we as a management company can do except be there as a support and try to explain what is happening along with the attorney and show up for court if he d=needed us toMr*** was incredibly difficult to work with which is understandable considering the terrible situation this tenant placed him in but we continued to assist him free of charge for an additional 9-monthsOnce Mr *** accussed REI of lying and getting him into the situation, the management contract had expired, and Mr*** hired a new attorney REI did not renew his agreement
REI was looking out for Mr*** best interest when we strongly encouraged him not to accept this tenantOnce he allowed the eviction to be initiated there was nothing more we could do for himIt was in the courts hands at that point
Regarding the $10K earnest money, Mr*** clearly does not understand how Missouri law works in regards to releasing funds on a sale contractThe funds were held by an Escrow/Title company and can not be released to any party until a mutual release is signed by both parties or a court decides where it goesREI can not legally determine who or when either party receives the moneyIf we did then the other party could and would file suit against us
