Here is our response to complaint #***Please let me know if you need anything additional: Applicants are not required to leave a damage deposit when they apply for one of our rental properties Applicants select and sign one of two options when they apply The first option is
to place the damage deposit and the property will be held off the rental market for that applicant This option clearly states that, the deposit is only refundable in the event the applicant is denied therefore, if the applicant chooses to back out the full damage deposit will be forfeited as liquidated damagesThe second option is to apply without placing the damage deposit and the property will not be held off the rental market for that applicant.As far as our lease agreement, the application that all applicants sign clearly states on the first page, “I agree that I have read the above requirements for approval prior to submitting this application and that all of my questions regarding the lease terms and conditions have been answered I am aware that I can view a copy of the lease at any time prior to submitting this application” We also have a sample lease agreement printed out in our office for applicants to view Applicants are given every opportunity to view our lease agreement and to have any of their questions regarding our lease terms and conditions answered prior to applying for our rental properties.*** applied for one our rental properties on 11/5/and he chose to place the damage deposit for the property so it would be held off the rental market for him while his application was pending *** was approved for the rental property, but seven days after applying for the property, 11/12/*** chose to back out of renting the property We told him that he could back out, but per his signed application he would have to forfeit his full damage deposit as liquidated damages due to lost rents *** argued that the full deposit was too much*** then offered us $of the damage deposit instead of the full deposit of $The property owner agreed, so we refunded the remaining $to ***.
