The explanation given by the Business is inaccurate and contains falsehoods.I have attached text correspondence for your reference.First, the Dealer is stating that there was an agreement to pick up the auto in question from the [redacted] Mechanic Shop located on Kemp Rd. Kemp Rd does not exist nor is there a [redacted] Mechanic Shop. An attempt to retrieve the vehicle was made at a home garage on Kent Street where a back alley mechanic who was arranged by the dealer to fix the automobile. ThIs "Mechanic"stated the car was not completely fixed. At this time a rental car was obtained and a request was made of the dealer to discount the first payment which was scheduled to be made on November 13th, however the paperwork stated November 6th in error and was corrected at the closing. This problem began from day one and through out and attempt was made daily to get the car, however the "Mechanic would not make himself available and when he did would not guaranty the work was completed and the issues corrected. At this point the Dealer stopped communication. Thursday November 2nd the dealer was instructed via phone message and text that the car still was not fixed per the "Mechanic' and that the down payment should be returned and the vehicle had been left in the "Mechanic's garage". This all occurred prior to the first payment ever becoming due. No attempts to contact us were made at any time by the Dealer and no payments were ever forfeited, so there was no need for any attempt to repo as stated by the Dealer in his answer. At no time did we have this auto long enough to get any use or enjoyment from it. Therefore, for the Dealer to refuse to return the down payment even the car is not in our possession and was only in it for 1 day it seems as if a fraud was perpetrated from the beginning.
