[redacted] or on behalf of WestCadence Inc. Due to a human error from our sales representative, WestCadence was mislabeled under an existing client’s name and therefore inaccurately invoiced. We apologize for any inconvenience this has caused. All invoices associated with WestCadence Inc. and [redacted] have been cancelled. To address Mr. [redacted]’s “fraud” accusation regarding Municipal Publishing, I would like to provide additional information regarding our business practices. For the past 15 years, MP has published an annual Guide, an important and useful directory of Colorado’s municipalities and regional agencies. Until 2012, the Guide was printed and mailed directly to elected officials and government administrators across the state. More recently (commencing with the 2013 edition), due to changes in the availability of and access to digital media, the Guide has been exclusively made available online (www. co-municipalities.com) and in printable .pdf format for municipalities to download to suit their own needs. MP has and continues to provide the Guide to Colorado’s elected officials and government administrators at no cost. Recipients are free to distribute the Guide to others; and indeed, some municipalities have made the Guide available on their own websites, so that everyone within the state/community and the general public may benefit from it. To help underwrite the cost of preparing and distributing this free Guide, MP sells advertising. And it does so by offering its advertisers the ability to place ads in various targeted sections of the Guide, depending on their needs and interests, which is consistent with most similar directories that contain advertising. MP is proud the Guide is an important information tool for municipalities in Colorado. We trust that this information is sufficient for your purposes. If you need anything further, please do not hesitate to let me know.

I am rejecting this response because:First of all no confirmation letter was ever received by anyone that works here. Furthermore, isn't it odd that your confirmation letter isn't even signed?I made reference to the cost because that was not the price I was told over the phone. I never signed anything nor did I give a credit card to accept your advertising. I was asked to submit a business card so you could show me what the add would look like if I accepted your proposal.I try and show some business respect to other sales people because I am in sales, but that will be changing. I see similar complaints on the Revdex.com here and in other states so I am not, obviously, the only one you've tried to do this to.

We are writing in response to your letter of August 3, 2015. We have reviewed the additional information and wish to respond. We continue to believe that Ms. [redacted]-[redacted]’s complaint is nothing more than a transparent effort to avoid paying a just and due obligation.  This is a very clear and straightforward matter. On November 6, 2014 [redacted] purchased an advertisement in the 2014-15 [redacted] Municipal Guide as agreed to by [redacted] during a phone conversation with our sales representative.  On the same day, Municipal Publishing sent contemporaneous confirmation to the email address of [redacted]. On November 14, 2014 Municipal Publishing received an email from [redacted] [redacted]-[redacted], President for [redacted] with advertising copy enclosed.   In addition, on February 5, 2015, a digital link of the 2014-15 [redacted] Municipal Guide was sent to [redacted] [redacted] as proof of performance as is customary in our normal course of business.  The advertisement, provided by [redacted], appeared on page 26 of the 66-page statewide municipal guide (which may be found at [redacted]/).  Along with the proof of performance, an invoice was provided and collections efforts have been in place since that time. Although several opportunities were presented to them; at no point did [redacted] raise an issue with the advertising they had committed to. This includes a written confirmation, exchange with our copy department resulting in [redacted] providing ad copy, and receiving a digital link to the publication clearly validating the existence of the product as well as their participation. Furthermore, [redacted] received multiple invoices without expressing any concerns. It wasn’t until May 8, 2015 that we learned of any matter of contention when Mr. [redacted] [redacted] implied that he did not authorize the purchase of the advertisement, 5 months after receiving the full benefit of advertising in the [redacted] Municipal Guide. The reason [redacted] continues to receive phone calls and invoices for this publication is that they continue to refuse to pay for the advertising long after having had the benefit of their company’s advertising appear in the publication.
