This complaint against [redacted] and his company [redacted], LLC is based on the following: On August 11th, I met [redacted] from [redacted] at location that was under construction in the 2525 Cmno Del Rio South building. [redacted] presented the suites of about 8 treatment rooms for people in the...

therapeutic and holistic professions. That day, I provided her a check for $780.00 which was cashed on August 23rd, three days prior my signing their agreement for use of one of their rooms for my business. On or about August 26, 2017 I signed a membership contract "…for the use of space at [redacted] starting September 15, 2017”. After signing the agreement, I felt the situation would not be good for my services. I felt that [redacted] misrepresented the office as “professional” when I noticed signage on an estheticians room (not normally classified as a wellness practitioner, but instead beauty) that was a huge black and white funky sign that said “Sugar and Spice.” Not claiming any direct facts, but my impression made me wonder if the space was actually used for prostitution rather than esthetician services. Whether it was or not, I did feel that it would have a negative impact on my own business and decided to continue looking for space. So on September 6th, I notified [redacted] office manager that I decided not to move into their office space., I offered to pay a small fee for the 11 days of “holding a space” because I assumed that I was signing a lease for the room. Later I realized it wasn’t even a lease but an actual membership. [redacted] did not know how to handle the return of my deposit. She contacted [redacted] who told her that I needed to give them 30 days notice despite the contract was still not in effect. On September 9th, [redacted] attempted to send a “refund” of $208 of the $780.00 which I returned requesting a corrected refund. To date, I have not received the correct refund. From this action, it appears that [redacted] was trying to incorporate the September 15th date into his own calculations. Yet, mistakenly so. Because the agreement was not in effect and no performance of the contract had been done. I never received keys to the room nor any other space under [redacted]. I never used any of their facilities in any other capacity. And, I never received a signed copy of our contract. [redacted] attempted to calculated a 30 day notice starting from September 7th through October 7th and then attempted to refund 8 days from the effective date of the contract-October 8th through the 15th. Had Mr. [redacted] accepted my offer of paying him from holding a space for 11 days, I would have most likely remained under the assumption that I had signed a lease. But I did not sign a lease, I signed a membership. Because this was a membership and I had not been provided any benefits as a member as well as the effective date being clearly stipulated to begin on September 15th, I realized based on contract law, that I did not need to offer Mr. [redacted] anything and that I should receive my $780.00 back in full. Mr. [redacted] was provided several links regarding contract laws regarding effective dates versus signing dates. Mr. [redacted] did not respond and has violated his own agreement of returning my deposit within 21 days. I am requesting that a full refund be made based on the above facts. I am hoping this can be resolved without further legal implications.

To avoid similar issues with other customers, I would recommend that they make it clear that the policy can only be cancelled by phone.

I would like to add that I don't believe this was an innocent mistake on the part of the company, for the reasons described in my complaint. A reputable business would not try to get me to agree to stop any further action for 50% of the fraudulent charges. Thank you very much!!!

Due to no cancellation the autoship program took effect.The following month on 10/26/2017 we attempted to charge $94.95 for another shipment of skin serum but the charge was declined. The customer contacted our Customer Service on 10/28/2017 and requested for their subscription to be cancelled, which we did. The customer also requested a refund so we processed a 50% refund in the amount of $48.00. However we feel for our customer’s concerns and do apologize for the inconvenience, thus will be providing the remaining refund for the charge on 09/26/2017 for the skin serum in the amount of $46.95 for any misunderstanding when placing the order. Unfortunately the customer’s order hit a glitch in our system,which resulted in the customer being subscribed to 7 additional trial orders. The trials expired on 12/05/2017  in which the customer was charged  $94.95 x 8 for the  8 shipments of Skin Serum.Customer contacted our Customer Service on 12/22/2017 and requested for their subscription to be cancelled, which we did.The customer also requested a refund unfortunately our Customer Service was unaware of the system glitch and only offered the customer 2 refunds of $94.95.However we feel for our customer’s concerns and do apologize for the inconvenience, thus will be refunding the customer of all charges.The Customer may also keep all shipments as a way to apologize to our customer for the error.
