This establishment offered a renewal of pool memberships for the 2016 season to 2015 members that responded to an offer on or before March 31, 2015 with the required membership fees. I sent a check for over 500 dollars to the address indicated in the email offer before March 31, 2015, and received confirmation that the application was received. In reliance upon this offer, I did not apply for a similar membership at another local establishment that I was considering as an alternative for the 2016 season that was offering a discount on its joining fees during the months of March and April. The owner of the establishment sent an email on 5/12/16 asking for proof that the check I sent was actually sent due to his failure to keep appropriate records. On 5/16/16, the owner informed me via email that there was not an opening at this establishment for the 2016 season. Due to the mismanagement and failure to communicate with his customers, my family lost the opportunity to apply at another establishment at a discount.Product_Or_Service: Pool MembershipDesired SettlementThis establishment should sent back my check or other proof that the check was destroyed, and pay me for the lost discount at an alternative establishment due to my acceptance and reliance upon their offer which they subsequently reneged upon.Business Response No refund is owed. The consumer's check was destroyed, not cashed.Consumer Response I provided the following response to this matter on June 1 as follows:I need to see proof that the check was destroyed, or have it returned. This establishment engages in sharp and unprofessional business practices, and cannot rely upon their word. Additionally, I relied upon this establishment's offer when I accepted it and paid the fee for 2016, and did not seek to join an alternative recreation center during the time I could have received a discount. I can demonstrate clear reliance damages and lost opportunity costs of 250$ due to their reneging on their offer. The public should be aware of the rude, discourteous, and unprofessional nature of the operator of this establishment.I do not know why the above information was not received, but submitted it prior to the June 7 deadline. Please advise.
