Here’s the Association response to the below complaintIf we need to submit this via your website please let me knowMs*** is disappointed that the association decided to exercise its right of first refusal to purchase a condominium unit that she wished to purchase as an investor. The association handled this situation in a professional and fair manner given the requirements of its governing documents and Connecticut lawUnder Section of the declaration of Watertown Old Farms, when a unit owner enters into an agreement to sell his or her unit, that owner is required to inform the association of such and to provide it with a copy of the proposed purchase and sales agreement. In this case, however, the association did not become aware of the proposed sale of the unit until it received the request for the resale certificate. The association did not immediately issue the resale certificate because it was not yet in a position to decide whether to exercise its right of first refusal, and it did not want to unfairly accept money from Ms*** and issue the certificate while the possibility of exercising this right still existedThe proposed purchase and sales agreement was not provided to the association until November 24, 2014. The association then had days from that date, or until December 9, 2014, to inform the parties that it had decided to exercise its right of first refusal. The association informed the parties of this decision on December 2, well within this time period

I am rejecting this response because: while the association claims it has fifteen days, CT Real Estate Laws require the resale certificate to be issued within 10 days of the request of the resale certificate. Had their response been made within...
the required 10 days, monies would not have been spent on inspections and mortgage approval. Please see the CT State Regulations below. The resale certificate was requested on 10/28/2014.
Chapter 828 Common Interest Ownership Act
Sec. 47-270. Resales of units.
(b) (1) Not later than ten business days after receipt of a request in a record from a unit owner and payment by the unit owner of a fee established by the association that does not exceed one hundred twenty-five dollars plus either five cents for each page of document copies provided by the association pursuant to this section or a flat fee of ten dollars for an electronic version of those documents, for the preparation of the certificate and other documents, the association shall furnish a certificate containing the information necessary to enable the unit owner to comply with this section and any other documents required by this section. An additional fee of not more than ten dollars for expedited preparation may be established if the certificate and all required documents are furnished to the unit owner not later than three business days after the request in a record is received by the association. No fee under this subsection may include costs for services provided by an attorney or paralegal.
