that she has had an on going mold issue and plumbing problems in the apartment that she leased. She also stated that problems were not fixed and there was no response to her calls. 1 strongly disagree with her statements for the following reasons. 1. Attached is a work order detail directory showing all of the work done on the apartment prior to her moving in as well as during her tenancy. As can be seen, we did write up work orders and our response time is quite good. 2. We did take care of a mildew problem, as is listed in the work order detail directory. We believe the issue was mildew and not mold. The tenant did sign a Mold Notification Lease Addendum (enclosed), which was not followed by the tenant. 3. The tenant was served a three day right to cure for non-payment of rents and other charges. When. no action was taken on the tenant's part after the three day notice was served; we proceeded with a court eviction process and received judgment for possession. At the time of the court proceeding, the tenant had the opportunity to use the Colorado Warrant of Habitability statute as a defense during the eviction process. The tenant did not do that as possession was granted with no exception. 4. We will not be crediting the tenant with any funds as she has requested. As of today, the tenant owes $1,315.41 in rents, late fees, etc. This is a substantial amount due for an apartment that rented for $575.00 per month. 5. Further, the tenant left the apartment in very poor condition which will result in substantial additional charges. The damages include broken and damaged windows and no cleaning or carpet shampooing being performed as is required by the lease. A copy of the move out inspection is attached and the last page of the work order detail directory will show the work orders written up from the inspection. Not all items noticed on the inspection will be a tenant charge.l have circled the items that will be charged back to the tenant. 6. To further insure that there is not a mold problem, we have hired a mold abatement company to test the property and will handle any findings in the proper legal way. In conclusion, the tenant complaints are unfounded and we will be pursuing collection of all funds owed to us from the tenant. Sincerely, Steve Reed
