community as a personal property item.

The other damage in your wall I s termite damage that is years and  years old, possibly  10+.  The association can not take responsibility for damage that happened that long ago.

You mentioned that you have already agreed to remove your pergola and stucco over the exposed area. This will stop any further leakage.

In regards to your interior damage, you should have followed through with your homeowners insurance claim.  I realize that it has been too long now and your insurance won't cover it. You may want to ask them what their policy is on termite damage claims.

In closing, it is the board's decision that your damage should have been covered by your personal homeowners

insurance.  The association cannot be held responsible for damage that occurs due to faulty or degradation of personal property .
