reviewing the account, our representatives attempted to contact the customer several times throughout the month of August but did not receive a response until August 31st. Her account was delinquent at the time and she was informed of that fact. In the next conversation with Ms. [redacted], on September 5th, we informed her that options are available for consumers impacted by the hurricane. Although she set up a payment at time and is current on the account, if Ms. [redacted] requires assistance with future payments she is welcome to reach out to her account manager Paul H[redacted] directly.   If Ms. [redacted] has any other questions or concerns I would encourage her to reach out to me directly. In response to this complaint, I have reviewed the payment history and notes. Having analyzed the matter, I believe we have followed all applicable laws and contract stipulations. 2012 Ms. [redacted] entered into a 72 month contract to purchase a vehicle. To date, only 52 of the payments have been made. Additionally, the account has a number of issues that have impacted the current balance. First, only 8 of the 52 payments have been made on time. Ms. [redacted]’s payments have been a total of 408 days late, averaging a little more than 7 days late on each payment. Second, 20 of the 52 payments made were partial amounts less than the contracted installment amount of $519.62. Third, Ms. [redacted] received a 60 day extension on July 29th, 2014 allowing her to skip her July and August 2014 payments and have them added to the end of the loan. These events have led to the accrual of additional interest, as well as several late fees.    Additionally, the vehicle was impounded and repossessed for failing to pay tickets twice, in both June and December of 2014. In both instances the consumer did not have the funds to recover the vehicle and we paid $965.00 and $1,115.00 respectively to get the collateral out of impound. There were also $332.00 in repossession fees. The previously mentioned 60 day deferment provided to the consumer was an attempt to allow her to take care of her tickets. I have not recived the title nor letter, nor refund of 180 dollars.  My credit has not been updated to show paid in full so how has all my concerns been addressed.  Also, I would like someone to look at the numerous emails from the employees of their establishment.

In response to consumer complaint, Prestige Financial Services has reviewed Mrs. [redacted] account, in our findings we show that Mrs. [redacted] has had some late payments on her account causing most of her payments to go towards interest. Mrs. [redacted] is in rolled in our Rate Reduction program and will...

start seeing a different in her interest she pays. If Mrs. [redacted] is able to pay closer to her due date she would be able to see more go towards principal. I am rejecting this response because: Through emails and phone calls with American family it is not to just this month Jan 2018 that they were able to reach anyone from Prastige. I am constantly getting calls about making payments on a car I do not have  I have all the text emails and phone calls recorded and saved this should have been taken care of months ago. I’ve never known any company that took this long to settle. I guess next time I’ll just get an attorney to take care of all of this for me.

those days and Prestige is unable to move his due date past the 11th of each month. We are happy to continue to work with the consumer if he is needing more time to make his payment. In response to this complaint, I reviewed the account history and payment history.  We submitted an update to the credit reporting agencies to ensure that Mr. [redacted]’s credit report would get updated.  After conducting our investigation I believe we were able to resolve his issue. ...

Based on my review, Ms. [redacted] agreed to a credit card payment that included a $10.00 processing fee to be debited on January, 6th...

2017.  There was an error made by the account manager and Ms. [redacted] was charged an extra $50. Having reviewed the matter I believe this was an isolated incident and the result of our account manager mistyping the information.  The customer contacted our office on January, 6th 2017 and informed us of the error, during this conversation the account manager did apologize for his error. The $50 that was overcharged will be deposited into Ms. [redacted]’s account today January, 11th 2017. Unfortunately, the $10.00 credit card processing fee will not be refunded as the customer agreed to and authorized this amount. In response to this complaint, I have reviewed the account notes, text messages, and phone calls. Having analyzed the matter, I believe we addressed and resolve all of her concerns. First, I would like to offer an apology on behalf of Prestige to Ms. [redacted] for the way she was treated. We value her...

as a customer and would like her to have a positive experience going forward. Based on my review, the customer was transferred to her account manager when she asked for a supervisor. This has been addressed with management as well as the individual customer service representative. The Assistant Vice President of Collections spoke to Ms. [redacted] on 07/12/2017, and agreed that the statements made by the account manager were unnecessary and they were able to resolve the consumer’s concerns. The resolution includes a block on the account to stop courtesy reminders until the payment is at least one day past due and a new account manager.   If this does not meet Ms. [redacted] desired resolution or she has any other questions or concerns, I would encourage her to reach out to me directly. went over the importance of making on time payments and the possible default ramifications if the contractual obligation is not met. I also confirmed the details of the repossession guidelines in the state of NJ per her request. In consideration of the payment issue we have already contacted Ms. [redacted] and rescheduled her December installment for 12/21/2016 and assisted her with further arrangements until she is able to stabilize her financial situation. We value Ms. [redacted] as a customer and want her to have a positive experience. In response to this complaint, I have reviewed the account and payment history. Having analyzed the matter, I believe all payments have been applied correctly and the customers balance is correct. I personally reached out to Mr. [redacted] in an attempt to discuss his concerns, unfortunately I was...

unable to reach him. Based on my review, the original term of the contract was 66 months. However, based on the consumers request there were 90 days of payment extensions as well as another 28 days repayment delay in due date changes. Each time a payment extension or a due date change is requested the customer is read a disclosure informing them that interest continues to accrue which could result in the contract being extended. Additionally, out of the 67 payments made by Mr. [redacted] only 8 of the payments were made on or before the specified due date. This resulted in more interest accruing between the installments and several late fees. The customer also accrued several returned check fees throughout the life of the loan. As such, the current balance is correct. If Mr. [redacted] would like a copy of his contract or to discuss the balance in more specific detail I would encourage him to reach out to me directly. I am rejecting this response because:December's payment was only returned due to the mistake of Prestige Financial. I informed the company immediately that a mistake was made only to be told you couldn't charge 145.00 or offer that amount when my account manager did and that I needed a bank statement to proceed with any refunds. A second payment was returned due to fraudulent activity on my account and not due to insufficient funds. I was unaware my bank would reverse a payment with Prestige in May 2017. It is now June 6/6/17 and I have yet to receive a call on my vehicle or my personal belongings in the car. Prestige is known for selling customers vehicles and not applying the amount they auctioned the vehicle off for to their balance. It's illegal at this point to keep my personal belongings along with the car tag issued in my name. I will file a police report for my belongings and also seek legal action as Prestige had no authority to repossesse my vehicle. I must remind them I was NEVER LATE on my account until they messed my account up in December. This company is a predatory lender and the reviews on the consumer affairs website will prove many individuals are planning a class action lawsuit against this company. I offered to pay them any balance owed for the miss communication of a returned payment I was unaware of in May, but they refused to return the car in my possession.
