Review: I purchased The Doctor's Night Guard Advanced Comfort at the end of January 2014. I followed the directions to fit it properly for my teeth, but after trying 3 times, it always moved in my mouth with the slightest jaw movement. When lying down, it would move to the back of my throat, so I couldn't sleep with it. The product is guaranteed to fit and be comfortable, but I found it to be otherwise. I contacted them by email but they have not replied.Desired Settlement: I would like a refund of the amount I paid for it (CA$32.26).

Review: I purchased "DEBROX" at the recommendation of my primary care physician. Upon using it, I became very sick and has been seeing a specialist. Company has all documentationDesired Settlement: As agreed in writing by the company payment for transport, medical bills,m product and pain & suffering.

Business

Response:

Dear Mid-Hudson Dispute

Services Mediator:

Thank you for bringing to our attention

Ms. [redacted]'scomplaint that she used [redacted]

in her ear and immediately upon using it she became very sick and has been seeing a specialist

She has now requested $2000 to cover her purchase, transportation to the specialist and for pain and suffering.

According to Ms. [redacted]' s medical report,

she was diaiinosed with an ear infection

(acute otis medialblocked eustacian tube) further complicated by tympanosclerosts.

Tympanosclerosis is thought to be a complication of prolonged otitis media. It is not uncommon for patients to be misdiagnosed with ear wax by their primary

physician, only to find out that the cause of their initial

ear dis:omfort was in fact an ear infection.

In her original

Incident Report, received

February **, 2013, Ms. [redacted]

requested reimbursement of$I 0.49 for the cost of the product, $20 for co-pay to her doctor,

$120 for transportation and an undisclosed amount

for pain and suffering. Despite what appeared to be a pre-existing condition that should have prevented

her from using [redacted], we made a good faith offer of $200, our only written offer,

which she declined.

After a lot of back and forth emails, on July **, 2013, Ms. [redacted] requested

"reimbursement for the product as well as co-payment

for medication in the amount of $42.00 and co-payments for Dr. [redacted]

In the amount of# 4 x 4 =

$20.00. I would like to

ask for $1,000 for pain and suffering

and continued visits

to the specialist."

At that time,

we informed Ms. [redacted] that, considering her claim involves

ongoing treatment for what may be a pre-existing condition, we would have to wait for her final treatment and expenses to make any further evaluation.

The Division

of Consumer Protection letter is the first time we'vebeen notified

that Ms. [redacted] is seeking

$2000 in restitution.

However, since It appears that the causation for her condition

was her ear Infection and not her use of [redacted],

we think it is unlikely

that we will increase our original $200 offer.

Please let me know if you have any questions or require additional

information.

[Your Answer Here] The doctor has attempted to contact the business and the business says it also called the doctor. I believe they should have spoken by now. I await to hear back. Response:

I had a chance to speak to Dr. [redacted] last week. We

spoke briefly. He offered no new information at that time except to say

he was unaware of any ear infection when he recommend [redacted]. I explained

that if he had any additional information he wanted us to consider in this

matter, we would ask that he submit it in writing and I provided my email

address.

We will take no new action until and unless we receive

additional information in writing from Dr. [redacted].

Review: I bought Efferdent Power Clean Crystals at Walmart (zip code [redacted]) which were advertised as effective for cleaning orthodontia, mouth guards and retainers. I have a mouth guard for grinding and bleaching. I read the directions which stated to place the crystals in warm water, insert the item to be cleaned, stir and remove after 3 minutes. When I inserted a spoon to stir, I realized that my mouth guard had dissolved and unshaped in the solution. I contacted Prestige Brands (of whom did not seem suprised that it ruined my mouth guard) and they opened a case ([redacted]) September *, 2013. I was required to send them a description of the problem, pictures of the damaged items and two estimates for replacement of the mouth guard. I priority mailed this to the company on September **, 2013. As of today, December **, 2013, I have called them 5 times, and each time I call, I get the same response that "The case has been forwarded to our corporate office and you will have a resolution in 24-48 hours." This is extreme. The night guard that I wear is to prevent grinding and clenching in my jaw. Due to missing this for over 3 months, I have headaches on a daily basis. By not resolving this issue, it is effecting my health.Desired Settlement: I am asking for them to refund to me the out of pocket cost ($250) for me to have the night guard replaced, plus time spent going to two different dental offices, the multiple phone calls I have made, and the stress I have encounted from this issue ($50) = $300. I am asking for a check for $300 as reimbursement. I feel this is not a exorborant request.

Response:

[redacted] writes that she used Efferdent® Crystals Denture Cleaner on a professional bleaching tray. Our Efferdent® product is intended to be used for cleaning dentures, as stated on the package, and also can be used on retainers and mouth guards. Use of our product to clean a bleaching tray, made from a material

of unknown origin, is a misuse of our product. The ingredients in our Efferdent® Crystals are similar to other denture cleaners on the market. This person used our product to clean an item not of the type indicated on our package label. This is an off-label use and this claim for restitution is, accordingly, denied.

I'm not sure what additional information you require. We do not have any additional formal process. Hope you also have a Happy and Healthy New Year.

Response:

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

My complaint has NOT been resolved. According to the packaging on the box, that I sent back to Prestige Brands with my claim, it states that "Efferdent Power Clean Crystals - Great for Retainers or Mouth Guards." (this can also be viewed on their website). The item I was cleaning was a mouth guard. The packaging does not state that it is only for dentures. There is no warning on the packing to distinguish ONLY for dentures. That is a different product.

To satisfy my claim, I would like for my mouth guard to be replaced. Again, this is relating to my overall health. If need be, the check can be made payable to my primary dental office, [redacted].

Thank you.

Review: I purchased my daughter Efferdent ([redacted]) fresh guard cleaner (cleans braces, mouth guard and retainer) here are the directions: Take a clean, empty container (e.g., plastic cup or a glass) and fill with enough warm water to fully submerge the device. Then tear open one packet and pour contents into the water. The solution will foam up and turn blue. Place your retainer, mouth guard, clear braces or even your plastic case, in the effervescing solution. Soak for 5 minutes. The solution will start to turn clear when it's ready. Remove your device, and rinse thoroughly. Do not soak for more than 10 minutes. She placed her braces in the solution for about 3 to 5 minutes maybe less; the solution did not turn blue so she took the braces out, when she looked at them she seen that they were damaged, the solution had over heated and melted the retainer, so she is unable to wear the retainers, I sent an incident report along with pictures of the damaged retainers. Efferdent ([redacted]) did send me my money back for the purchase of the product, but I also sent information asking them to replace the damaged retainers, they informed me the claim was denied unknown why and that they will not replace her retainer. I took my daughter to the orthodontist (January **, 2015), to see if they can fix the problem the orthodontist stated the retainers are damaged because they were overheated and that her gap is opening back up and we will either have to start her treatment back over one year more of braces or replace retainer and leave teeth as is.Desired Settlement: I would like to be made whole, she just got her braces off on November *, 2014, I purchased the product in December 2014, and she was only able to wear her retainer for about a month before the damages. My first choice is to restart her treatment over or my second choice replace retainer and leave teeth as is.

Review: I called on Nov-[redacted]-2014 to get some info on the Little Remedies Gripe Water product.

Service person who I was speaking to was not able to know the answer and said they have to escalate the issue and someone will call me back.

Waited for 3-4 days and called them to get the answer but they said the same thing.

I did not receive a call back from them until now.Desired Settlement: Need explanation why they did not call with the anwser I wanted.s

Review: I purchased the The Doctor's NightGuard from [redacted] in Kannapolis, NC several months ago. I followed the directions and when the item did not fit properly I again followed the directions with the same results. I even tried once more just to be sure, and the mouth piece would not stay in place. I emailed the company through their web site and was told a replacement would be sent to me (as their product guarantee states). I never received the replacement and once again contacted the company. I was informed at that time to give it another week to see if it arrived, and when it did not I contacted them again. I received a rather rude response but contacted them again and told them the situation. When nothing showed up after a few more weeks I contacted them yet again with no response.Desired Settlement: I do not appreciate being treated so poorly by this company, and they do not honor their guarantee. I no longer wish to have the replacement and I would like a refund of the purchase price.
