As per the lease pest control is a tenant responsibility and they signed and agreed to that The tenants created a fertile condition for pests to find safe haven in their home. Adjoining units did not have same issue (as per property mgr) I treated the lawn Tenant's husband
reported that they had treated both personally and professionally (words they usedwe had it treatedI inferred that to mean we had paid someone to do it professionally) the unit (in email form this was communicated) I asked that the tenant provide proof of treatment No proof was forwarded Issue was seemingly dropped This was MONTHS AGO.Recently the issue has arisen again I transitioned property to a property mgr The tenant withheld rent initially with the new property mgr Then tenant communicated to me that they have never communicated that they had the unit treated Before the Revdex.com the tenant had communicated issue with city codes/health.I addressed issue squarely with their action officer as well We outlined that it was contractually captured in the lease Issue was dropped by them (as I understand the action officers last verbal communication) Their is a correlation of failing to mow their back yard's tall grass and the spring time heavy rains as being the prime contributing factors for the pest finding safe haven near their back door I referred tenant to a pest control specialist who would do the (2) treatments required to eliminate the issue on the cheap.I am at a loss.What the tenant fails to understand is that if I absorb the costs for them (deviating from the lease terms) then there are lawyers on this planet that would argue I have committed a discriminatory practice if I do not do the same thing for each and every tenant By their own estimate pest control treatment is X tenants is $95,per year for pest control....*** ***, MATexas Real Estate Broker/Property Manager/Real Estate Investor*** * ***
