In response to rejection : It is true we walked around house and agreed downstairs windows will be recapped which is why he was charged for them in the contractcustomer states upper windows were one year old and said he was never told they could be damaged and there would be an additional charge of $per windowHe said in rejection "who would ever agree to that" My response is, it was discussed before signing of contract and he did agree to it verbally and in writing as stated on contractThat is why that line item is in the contractIf it was never discussed why would it be in the contract? His statement is entirely untrue ! Contractor explained to customer boards surrounding upper windows must be removed to install vinyl sidingThey were not 2" x 2" trim as statedThey completely surrounded upper windows and were screwed and caulked to upper window capping and wallThat is why he was informed about a possible additional charge verbally and in writing as stated on the contractThere were upper windows with boards around them and because of contractors careful removal, only one had a problemCustomer states the trim could have been pulled off by hand, which is impossible ! The one damaged window was brought to my attention by his wife and recapped along with punch list immediately When I came back to complete the punch list his wife became irate, stated crying and my employees also she was unstable and going to have a nervous breakdown She did not want to pay the final check, more or less any of the extra chargesI even called her husband at work to tell him about his wife's behaviorI have been in business for years and have never seen a customer react like thatCustomer also states this was the first time he is hearing about extra pieces of plywood Once again it is in writing in the contract signed by both of us Rear upper wall was finished properly Customer still insisted he wanted siding in an area where there was no wood to nail siding toThat is when I installed extra sheets of plywood to appease customers wishes, even though I explained it was incorrectI told him siding could not be nailed to air, there has to be some framing structure to hold it all togetherThat is why there were extra sheets installed as stated in contractYes there was a final punch list which was taken care of immediately even though customer's wife was cursing profusely and child on childs birthday ! It was very sad ! Another lie is him saying check was cashed the same day That is impossible because checks made out to a business may not be cashedBy law they must be deposited in a business account only ! In closing the only thing that matters is whats is in writing in the contract, because that is what we both agreed to and cannot be changed without an addendum in writing Please feel free to contact me by phone about this frivolous attempt to get out of paying for agreed charges at [redacted] I have a signed contract which I would be happy to mail or fax to you.I am sorry but I cannot scan my contractsPlease contact meThank you, Rich Skretowski

Please note the original contract I have attached states that any capping of upper windows is an additional cost of $per window Boards were around old existing capping and had to be removed to install new siding Contractor told customer capping might get slightly damaged when
boards were removed, and recommended recapping Customer requested reusing old capping onlyThere were windows and only one had slight dents after VERY CAREFULLY removing OLD capping The customer would not give final payment to owner until new capping was put on and would not pay $as stated in contract ! That window was recapped and never paid for ! Now customer says two more windows need new recapping and still has not paid for the one, $60.00Also as stated in the contract any sheets over 6, to replace the rotted would be an additional $ Eight sheets were removed and the two extra were also not paid for, an additional $

I am rejecting this response because: When contractor and customer initially walked around property, we agreed the downstairs windows would be re-capped because they were old (years)I told contractor the upper windows were new (one year) He NEVER stated he was going to have to damage them and then charge me for it, who would agree to that?Imagine bringing your car in for an oil change and mechanic tells you that it may be necessary for you to pay for a new windshield because he will probably damage it while working on your engine? What we did agree upon was that windows were new and would not need to be recappedThe only "boards" around windows were 2"x2" trim, that were as old as the T-original siding on house and could have been pulled off by handThe new capping was damaged during install, which contractor admitted to. Contractor never asked for $because he knew his employees damaged them during install, not during removal of rotting trim This is the first time I am hearing about extra sheets of plywood even when I asked about extra sheets towards end of job and was told he did not need to use extra Contractor was paid as he went according to his contractThe last payment was not held upAs in most contractor jobs customer and contractor do final walk through and anything that is not done satisfactorily, is addressed, at which time final payment is madeOn this particular job there were about or clearly obvious things that contractor had to take care of (none of which were the windows, the last two windows I noticed when looking up at the area where siding was already falling off the house, two days after job was "finished".) I will attach list if necessary. Contractor accepted payment in full on last day (cashing check same day) and never once stated I owed him anything more until now.
