This is in regards to Complaint # [redacted] Filed on 10/11/by [redacted] When the original claim was filed in 2014, the floor was inspected by an independent, third party inspector (not an employee of Poulin Lumber or affiliate of [redacted] Company) and the inspection determined the concerns were due to a rise in the subfloor causing a gap in the tilesThis inspection was paid for by Poulin Lumber in order to get an independent opinionWe are happy to order another inspection from a third party but as this is the second claim for the same floor, we request cost of the inspection be at the homeowner’s expense If the floor is indeed found defective, we will be happy to reimburse them for the cost of the inspectionFor the record, Poulin Lumber is simply passing on the inspection fees charged to usThe flooring is warranted by the manufacturer (not Poulin Lumber as we have emphasized to Ms [redacted] ) and claims are addressed and covered by the manufacturer ( [redacted] ) (again, not Poulin Lumber) Poulin Lumber does not offer a separate warranty on products In Ms [redacted] ’s correspondence she notes that [redacted] represented Poulin Lumber Mr [redacted] l is not an employee of Poulin Lumber, he is an independent contractor and installer and is in no way employed, compensated, or directly affiliated with Poulin Lumber, nor is he a representative of the products we sell The only warranty Poulin Lumber represents is the warranty of the manufacturerAttached are two files: the original inspection report (ID ***) completed on 4/25/by Richard Reed of Inspect Solutions and the letter from [redacted] , Incclaims department I have also attached a copy of the original warranty from [redacted] which clearly states to contact: [redacted] Claims Department, [redacted] *** [redacted] ” for all warranty issues Poulin Lumber has also been in contact with our Distributor for this product line and have shared the concerns of Ms [redacted] They have offered the following as a Good Will gesture to settle the concerns of the client despite the inspection report clearly pointing to issues with installation and the subfloorThey have offered to replace the flooring material with new stock of the same type for the client They have been clear to address a few concerns:• They will not cover labor, installation or removal as the inspection clearly outlines the problems/issues with the installation.• The issues with the subfloor not being level and flat need to be addressed and corrected or the issues will again repeat themselves.• The flooring is not warranted to “move” with the home or adjust to variations in the subfloor.• This offer is material only, not an offer of monetary credit of any kindPoulin Lumber is happy to work with our Ms [redacted] on possible solutions and have put Ms [redacted] in contract with our Distributor and [redacted] Again, Poulin Lumber does not provide warranties for any manufacturer’s products All product warranties are honored by the manufacturer Poulin Lumber also never sells an additional or enhanced warranty of any kind The Distributor has stepped forward to help resolve the concerns at their own expense for the replacing material They have asked Ms [redacted] to confirm that this offer is acceptable for full and final settlement of the issue on the flooring but Ms [redacted] has yet to respondPlease feel free to contact me if you have any questions or concerns
