July 27, 2019 I was contacted by *** from the Law office. I was given notice I had a debt to *** in the amount of $5078.84. I was told I had to pay immediately. Mr. suggested a settlement offer on that Friday stating I only had till the 31st of July to make the first of two payments of $1806.00 or the settlement offer of $3612.00 would not be allowed. I requested a statement from the company as proof of the debt and was denied that prior to payment request. I followed through on the agreement and make the payment via etransfer as requested by the office. I requested a receipt for the payment and was told I'd get it in 48hrs . 7 days later I again asked for proof of the debt and a receipt for payment. I was not given a reply. 9 days after payment and 10 emails from me, I was given proof of debt and a receipt not depicting our settlement arrangement. Furthermore the proof of debt statement did not match the amount being requested, it was a lesser amount of $4443.59. I've contacted the office 15 times via telephone starting July 31, 2019 up until today August 15, 2019 and have yet to have Mr. accept or return a call to discuss the repayment. I do not feel the office is following the laws set out in the CDSSA (act pertaining to collection regulations) I am left unable to proceed and still being told via email that they will get back to me. My next and final payment is to be made August 31, 2019 and I am uncomfortable with not having any written confirmation of this from the office. I'd like to have it reviewed to see if the collection practices are being followed properly by this firm and this employee.
I'd like to know my full rights and if the office is following the legal guidelines for collection in the Collection and debt settlement services act. In particular sections 16
Good Afternoon and thank-you for your notification. The consumers account was placed at PB by our client for due collections. I personally spoke with the consumer and was alerted to her particular circumstances, at that point, I presented a repayment scenario based on a settlement over multiple payments. this was designed to accommodate the consumers circumstances. I continue to make attempts to have that scenario approved by our client. At the same time, I advised the consumer to make an immediate partial payment in order to demonstrate commitment to repaying: this was done and payment acknowledged. In the interim, I am procuring copies of statements form the original creditor at the consumer's request in support of divorce proceedings on her end.
I continue to work with the original creditor to have the settlement vetted. at no time did I advise the consumer the settlement is approved, I did advise I would work to make efforts toward that. the consumer will be advised accordingly.
I just now have received an email from the lawyer in charge ***. Who claims to have informed me that his settlement wasn't reached however he still not returning the settlement payment nor have I received that information nor has he provided me with proof it was sent perhaps that is another avenue you can look at. I am not trying to get out of paying a debt when I'm trying to do is make sure that the rules are set out he's claiming that this collection agency gave it back to the original credit card company so where is my $1800 gone and why haven't they heard anything about it?
Your account was assigned to us for collection as a validated owing debt by our client. We as duly assigned collection agents reached out to you to collect the account. Once you described your circumstances to em that you were unable and not willing to pay the full amount, I suggested a lower amount to be paid in stages. I proposed this to our client for approval, as we are obligated to do, and they declined it. Your first payment toward the owing amount is a valid payment and has been applied to your account thus reducing the total owed. The account was recalled from us as collection agents in January 2020 and at that point our client handles the account as they see fit as is their right. I am more than happy to show you this history however as the account is no longer placed here, I cannot action the account and it is much more effective for you to reach out to our client and perhaps work out a new arrangement.
. Garnished my wages in 2017 and then again in 2019 for the same debt and went to my bank this time and not my employer.
