On April 26, 2018, I bought a new construction from Jason K at Edgewater Resources, Saint Joseph, MI. The purchase contract created an escrow for $7,788 in unfinished work included sodding the front yard and seeding the back yard. The work was contracted to Place Builders. Place Builders did not timely perform on this contract and as a result, spring and summer rain washed away my topsoil causing exposed drainage and loss of grade. Despite putting the company on notice in April that each rain caused flooding and loss of topsoil, Place Builders still didn't perform. Later in the summer of 2018, Place Builders seeded the back lawn but because this performance was not timely, the topsoil had run off and the yard had lost its proper grade. As such the seeds were put on a clay bed with no topsoil or grade which resulted in the seeds running off in the next rain, never taking, and continued flooding, loss of grade, and exposed drainage. I spoke with 5 third party contractors who said that the lawn was botched and would require 30 yards of topsoil and new drainage. The contractors quoted around $2,000 to do this. On October 1, 2018, I demanded cure and Place Builders refused to cure but still took my escrow money. Place Builders maintains that seeding the lawn was all they were required to do. This may have been the case if performance was timely and the grass took. Because performance was not timely, the grass never fully took and the lawn continues to degrade.

Thank you for allowing me to respond to the complaint. Yes, she is correct on the time line on not getting yard in very quickly. The soils in St. Joseph Mi consist of clay. With the amount of rain we had this summer it was tough to get the yard in. We needed 3 days of no rain to do the final grade. Then put sprinkler system in, then put landscaping in. The yard was sodded in the front and seeded in the sides and rear. As you can see by the attachment, (scroll to bottom for lawn care section), we do not warranty the yard after install. Weather and homeowner care play into that. However, we always go back and do a touch up seed. We actually did that two times and filled in low spots where the clay settled. One of the reasons that the seeded portion did not pop in certain areas is the homeowner did not fertilize one time all summer.
I am rejecting this response because:
1) The basis of this complaint is that work on the lawn was not timely and as a result the grade of the lawn was lost over spring and summer rain — the issue is not that the grass seed failed to take, although the seed did largely wash away.
2) Place Builders is aware the lawn is clay and washes away easily. Per attached emails saved in Word files, Place and S E were put in notice that the lawn was washing away as early as May 2018. When put on notice, place was sent the attached pictures titled “pre-landscaping runoff” showing lawn runoff showing the lawn washing away into the road.
3) Despite knowing the nature of the clay and being on notice of the extent of damage, Place did not sod or seed in a timely manner, also apparent in attached emails. In addition, despite knowing the nature of the clay and the extent of damage, Place installed French drains, which are ineffective, and overflow in clay lawns, per attached video after drain installation.
4) As a result, the back lawn lost its grade — something that had happened before seed was ever placed and something fertilizer cannot re-build.
5) The lawn must be re-built and graded with yards of new topsoil.

As I stated in an email that was sent to *** on 11/18/2018, that we would revisit it in the spring and see how the back yard comes in. At this time of the year nothing can be done due to soil conditions, weather and landscapers close for the winter.
