Please be advised that our office represents *** *** and P&L Mechanical Contractor LLC of Peabody, Massachusetts, in regard to the above entitled matterwe have been asked to respond to the above referenced complaint, which appears to be based upon the fact that the gas heating system
installed by my clients did not qualify for a rebate from *** *** or anyone elseAs you can see from the written contract, the system was supposed to be installed by my clients was actually and correctly installed in the premises as called for under the contract and there is nothing in the contract that indicates or in any way guarantees that the installed system will absolutely qualify for a rebate and no such representation was made by my clientsEquipment rebates fluctuate all the time and there is no guarantee that a rebate at one particular point in time will be in existence and available at a different timeas was indicated to the client, it is always their responsibility to check and determine whether the particular equipment they are having installed qualifies for a rebate at that specific timeBased on the foregoing, my client denies and liability for any failure of the installed equipment to qualify for a rebateHowever, because it appears that there may have been some, misunderstanding and my clients value their reputation in the community and with these clients, they are willing to extend an offer of to resolve this matter
