The company refuses to give me copies of the paperwork because the final purchase price was $6500 agreed to by the Sales manager & myself Also the tax,title & registration was only $65.28. I also was told I had to have a service contract because of the age of the vehicle which I said I did not want & his finance manager added it any way, He never said why the Document Fee was So much higher than any other dealer! The only way I will settle this is when I get a copy of my paperwork & a refund of the difference of the Purchase price we agreed upon & what I was charged & also the very unfair document fees! I also today received a form from AZ attorney general to file a complaint with them if the company will not settle!

April 4, 2016Ms. S[redacted] purchased her vehicle December, 2014.  At that time the customer signed a "mandatory disclosure" document which clearly states that any payments that are due or come due are the responsibility of the consumer.  As she stated, our staff directed her to contact Nissan...

North America Credit and inform them that she was in the process of trading in the vehicle. Ms. S[redacted] made the initial call, but did no follow up to ensure that the payment had been made or that NMAC was aware of the pending trade.As far as her credit being accessed by S[redacted] Bank, Ms. S[redacted] signed a credit application that gave us a permissible purpose to submit her credit application to various lenders.  This is common practice to obtain the best financing rate for our customers.Pinnacle Nissan did not report the late payments to the credit reporting agencies. We spoke to 3 different people who did not go through any contract line by line. He kept saying we got the online price and it didn't include the dealer add on or navigation and that is what increased the price, but that we were over charged and he would offer us the almost $500 check. We kept asking for something that showed exactly what the dealer add on were and the navigation price since we were told when we first came in and bought the car we wouldn't be charged. If he actually went over the document he brought in that I did not get before that I accidentally took we would have seen the $0 dealer add ons reflected at the bottom and no navigation charge listed. It also just showed the almost $30000 car price not online price either. We kept asking for documents/ breakdown of charges and the contract that was mentioned to me on the phone that they said they have a copy of that shows the lesser price with all the other charges and he couldnt. The 1st or 2nd guy actually said it's locked in the other room for processing or something so he couldn't get it. The 3rd guy pretty much said he was done with the conversation after asking and asking for the document and he was going around in circles and ended the conversation. Nothing was accomplished except for the fact that now I have a document that shows the proof that I was not charged the correct price, should not have had any dealer add ons charge, nor navigation charge. I did not stay to collect that check nor called to claim since I believe that was a way of paying me off and silencing me. Nothing was resolved.

For the sake of time and space, I was unable to provide all the information and evidence I wanted to. As a result, I have attached the fax that Pinnacle Nissan faxed in. I have also attached a much more detailed account of all my proactive follow-ups. Please advise.December 22nd- Spoke to finance director of Pinnacle Nissan AND NMACJanuary 7th- Spoke to CameronJanuary 8th- Spoke to NicoleJanuary 10th- Spoke to Cameron againJanuary 14th and 15th- Spoke to Cody, Cameron and Jeremiah. I did more than my fair share of follow ups. Please attached document for detailed accounts of dates, times, people and what was said. As for the Santander bank credit, I strongly refuse this and disagree to this. It was made clear that only NMAC was to run my credit. If there was a document allegedly signed stating otherwise, it was falsely and fraudently disclosed. I am then also requesting a copy of said document. April 7, 2016 We are in receipt of the complaint filed by [redacted] with your office.In the complaint Ms. [redacted] claims she is a victim of “senior abuse” regarding the service on her vehicle at Pinnacle Nissan.  Ms. [redacted] made this claim only after her son told her that she had been taken...

In the complaint Ms. [redacted] said that she only wanted minor work done, such as an oil change and tire light problem and possibly a 30,000-mile check.I personally listened to the call made by Ms. [redacted] to our service department to make the appointment and she clearly stated that she wanted to bring her vehicle in for 30,000-mile service. The advisor confirmed what it was that she was bringing her vehicle in for. He also advised her that this service would take more than 5 hours and arranged a rental vehicle for her to use at no charge.Please find attached a copy of the repair order for her vehicle. The work performed was more than a mere oil change or topping off fluids.  All of these repair items were discussed with Ms. [redacted] prior to the work being performed and she okayed all of the charges.We regret that Ms. [redacted] feels she was taken advantage of.  Pinnacle Nissan stands behind the work performed and the associated costs.Sincerely,[redacted]Compliance Director – Pinnacle Nissan

November 4, 2015Our position on this complaint has not changed.  A vehicle can be purchased when at least one of the borrowers has a valid license.  If there had not been a valid driver, the [redacted] would not have titled it back in 2014, nor would have a lender approved the loan.  This is an issue with the [redacted] and not Pinnacle Nissan.As stated in the first correspondence, we cannot change a contract which we do not hold.  The customer needs to contact the lien holder of the vehicle to have Mr. [redacted] name removed from the title, or with the [redacted].  There is nothing we can do to resolve the issue with the outstanding tickets for Mr. [redacted].[redacted]Compliance Director Pinnacle Nissan

the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
The payment that was received did not cover the costs of the 2012 Nissan [redacted] as stated in the response. The amount provided was the amount that was overcharged in the loan that was originated for the purchase of the 2015 Nissan [redacted]. Pinnacle Nissan had stated that I would not hold any financial obligation for the [redacted] upon purchasing the [redacted]. As stated, representatives of Pinnacle Nissan had made a commitment to me to pay off the lease in its entirety out of Pinnacle's gains from the Purchase of the 2015 [redacted] as there were rebates and incentives that came along with purchasing the 2015 Nissan [redacted] that would be applied to my existing lease instead of reducing the price of the [redacted] or going back to my pockets. Instead of having these rebates and incentives applied to my existing loan or going to the reduction of the price of my new vehicle purchase, I was charged the full retail value for the 2015 Nissan [redacted] (PLUS $6,600 on top of that retail pricing). Therefore, the check that I received from Pinnacle for $6,600 is money that I am perosnally responsbile for through the repayment of my new auto loan which totals over $42,000. The retail value on the [redacted] according to numerous well known and respected organizations is no more than $34,000 for this model and that takes into account every feature available for the vehicle. Regardless of all of these facts, the amount due that was to cover the remaining lease payments on the 2012 Nissan [redacted] is $8,400 not $6,600 as Pinnacle had stated at the time of the transaction. I was told that my account was looked up as the Nissan [redacted] was fiananced through Nissan [redacted] and this was the balance that was due. Even if I were to accept the $6,600 as a settlement of this matter (which I Do Not) I would still have an additional obligation of $1,650. Also, I have in writing that Pinnacle would cover any damages to the [redacted] upon inspection which will come at the time of evaluation. I am willing to settle this matter as I just want to be done with it. I would ask Pinnacle to split the difference with me on this situation and we end it there. I received the $6,600 which I can apply to the loan of the [redacted] so that I am not grossly overpaying for the 2015 [redacted]. Pinnacle had committed to me to pay of the remainder of the lease along with any damages that would be billed to by the leasing company at the time of inspection which I have in writing. As an effort to end this I would ask that Pinnacle cut me a check for $4,100 (half of the amount remaining on the lease) and hold true to covering the costs of any damages that might be determined by the finance company. (or if preferred, simply add an additional $500 (half of the amount assessed by Pinnacle Nissan's own staff as the cost of the damages) to cover the potential damages totaling $4,600. In summary, to resolve the issue and move on I am willing to accept $4,100 (half of the remaining balance of the lease) + the cost of damages to the [redacted] OR $4,600 (half of the remaining balance of the lease + assumed damages paid up front)If Nissan accepts this proposal, I will drop the issue and consider the matter resolved with no further action to attempt resolution.   I just want this to be done and over with and hopefully Pinnacle Nissan agrees. I am happy to sign off on any legal agreements stating that the matter is resolved and that no further action will be taken if one of the two options above can be agreed upon quickly.

None of the paperwork provided during the sale of the vehicle included the drive train information. I would like to see the paperwork that the dealership is calming they have.

Pinnacle Nissan has a wide range oflenders with whom we have a strong business relationship.   [redacted] credit application for the new2014 Nissan [redacted] was submitted to several of our lenders. Only one approved[redacted] application with a stipulation of an increase to the down payment. [redacted] stated that he did not have the additional down payment atthe time.  Our dealership/lenderagreement with [redacted] prohibits us from taking a hold checks to becashed with future dates. It was at this point that [redacted] indicated that he wanted to look ata used vehicle.  Our records indicatethat while this option was discussed, no official paperwork was completed orsubmitted to any lenders. We regret that we were unable to place [redacted] in the vehicle of hischoosing.  Thank you for the opportunityto respond to this complaint. Sincerely,   [redacted]Controller – Pinnacle Nissan

We are in receipt of the complaint filed by Mr. [redacted] with your office.   Please find attached a copy of the CarFax report that was given to the customer at the time of the vehicle purchase. The report clearly states that the vehicle had been in an accident on 9/23/2014. The report does not...

show that the repair of the vehicle was reported to CarFax.   Also attached is a “used vehicle CarFax disclosure. This disclosure, which was signed by Mr. [redacted] states that he accepts the vehicle in its present condition with regard to its current body, paint and mechanical condition.  That the dealer is released from any claims for prior mechanical problems, prior damage, and prior repairs, whether mechanical or paint and body or any other claim based on the history or condition of the vehicle.   Mr. [redacted] also signed a “delivery confirmation and acknowledgement” which states he had inspected the vehicle and was taking delivery of it as equipped.   Pinnacle Nissan did not make any repairs or paint the vehicle in any way.  It is possible that the previous owner had the vehicle repaired and that information was not reported to CarFax. Please refer to the last page of the CarFax report which states they take no responsibility for the accuracy or reliability of its information.   Thank you for the opportunity to respond to this complaint.

initially.  In reviewing the deal, none of the paperwork including the MVD title work indicated that the vehicle was 4WD.Herb J.[redacted], General Sales Manager has been in contact with Ms. C[redacted] regarding her issue.   At the present time, Pinnacle Nissan did not have any vehicles on the lot that met her specifications (4X4, and 8 passenger). On behalf of Pinnacle Nissan we apologize for the miscommunication between our Sales Staff and [redacted]. Pinnacle Nissan routinely works with customers that have credit challenges, and often we are able to obtain financing for those customers.  Unfortunately, with [redacted] there was only one lender that provided an approval. [redacted] sent back an approval with a very high interest rate and required a larger down payment. Pinnacle Nissan hasno control over a lender’s approval process. Our sales staff have been trained to provide “payment quotes” to customers when in the initial stages of the vehicle purchase.  Payment information such as interest rate,additional down payment monies, etc. are only obtained when the prospective car deal is sent to our finance department. Often times there are discrepancies between the initial “quote” and the final loan requirements.We apologize for the inconvenience [redacted] may have experienced.  We have addressed this issue with our Sales Staff and your feedback regarding this type of situation has proved to be invaluable.
