Review: I have sent a total of four requests asking for a refund for my race entry because I injured my knee. I have a doctor's orders not to run. The Phoenix Marathon is refusing to give me a refund, although the website says that refunds are issued under extenuating circumstances. I am physically unable to partipate in this race, and it's not fair that the Phoenix Marathon is keeping my money.Desired Settlement: I want a full refund of the $43 I paid when I registered for the race on April 1, 2013. The race is March 1, 2014.
Review: The "cancellation policy" link on the Phoenix Marathon website at the time of my enrollment and at the time of my requested deferral (I have a copy, for documentation purposes) stated as follows: " Deferrals-- We offer a one time deferral for next year’s event. To defer, please e-mail the Race Director at: [redacted]"
On Fri, Feb 28, 2014 at 7:27 AM, pursuant to the posted deferral policy, I contacted the race director of the Phoenix Marathon and requested the following regarding the 2014 marathon scheduled for March 1st: "As offered on your website regarding your cancellation policy, I would like to defer my entry into the 2014 Phoenix Marathon until next year. "
On March 17th (after a couple of follow up emails from me) I received a reply from [redacted] of the Phoenix Marathon: "Unfortunately, the deadline to defer had already passed by the time you sent the first email."
I noted that, for next year's (the 2015) Phoenix marathon, the website now includes a specific date/deadline for requesting a deferral. But there was no such deadline posted for the 2014 Phoenix marathon. I attached documentation to my correspondence with [redacted] (an image of the website) to verify this when I responded as such to [redacted] and the Race Director, [redacted]. But they have ignored my response and have chosen to not honor their 2014 Cancellation/Deferral policy.
I request only that the Phoenix Marathon honor their policy and provide me a deferral entry into the 2015 Marathon.
OR, if they cannot assure that my entry will not be tainted as a result of my diligence for them to honor their commitment, then they can simply refund me my entry fee
Note: I have documentation to back up my claims regarding what the Phoenix Marathon as far as their cancellation policyDesired Settlement: I request only that the Phoenix Marathon honor their policy and provide me a deferral entry into the 2015 Marathon.
IFF they cannot assure that my entry will not be tainted as a result of my diligence for them to honor their commitment, then they can simply refund me my entry fee (paid via credit card)
