Fraud. *** & his son *** are thieves and crooks. Tampered warranty card.
***'s sold me a Rolex no date Submariner with a tampered warranty card which does not show which year it was originally purchased and also the AD where the watch was purchased from was showing closed in 2017. If you look at the picture I've attached of the warranty card, you can clearly see that the last 2 digits have been written over. It clearly shows the original font being 2012 and then somehow it was traced over to show 2018. The watch had its "original stickers" on it and was priced at $*** when the retail on a XXXXXX is at $***. I paid above retail trusting this business only to find out later through multiple experts that the watch was highly likely a 2012 model which eliminates the 5 warranty on the wristwatch through Rolex for re sale buyers. By Rolex policy, the ADs have to remove the original stickers before selling the watch to a customer. I'm not sure how ***'s was able to obtain one with "original stickers". I sold the watch at a loss and a major lesson learned on my end. Prior to selling the watch at a loss I confronted both Mr. and his son *** very professionally and with knowledge that the watch was indeed not a 2018 model and nothing was done! No refund and no solution.
A message to *** and ***
Both of you have committed an INTENTIONAL and CRIMINAL act of obvious FRAUD. This was not something accidental. This was done on purpose and was something that you knew about doing. Key word FRAUD. This was examined and confirmed by multiple experts. You have manipulated the warranty card by selling it to your advantage.
I purchased this watch from them for $*** because I thought it was a newer model and new watch which it wasn't. They lied and tampered with the warranty card and switch the the last 2 digits of the year to make it look like a 2018 model. I found out through outside experts that the watch is a 2012 model and Phillipe tampered and manipulated the card and traced over the year to make it look like a 2018 model. I sold the watch at a $*** loss so I am demanding a refund of my loss for $***. This people have conducted an intentional act of fraud! criminals.
Mr. is conjecturing and factually inaccurate. His conclusions are based on misguided assumptions that are void of merit, and inherently contradicted by the terms and conditions of his signed purchase agreement.
"Unless otherwise specifically stated, all goods sold by ***'s are sold as previously purchased merchandise, in either used, or UNUSED condition."
As professional re-sellers of previously owned watches & fine jewelry, offered in either used or "unworn" condition, we expressly state that we have no affiliation with the manufacturer, or their warranty programs. Instead, we offer to supplant their warranty, with our own in house version, that starts from our clients date of purchase.
Our warranty policy was explained in detail at the point of sale, and is highlighted on the customer's signed invoice. We make no claims on dates of production, or the next purchaser's ability to obtain warranty service through the manufacturer directly, or to any 3rd party via resale; To the contrary, we explicitly state that the manufacturer's warranty is NOT valid when purchasing any item we sell. (See below - As stated on Signed Invoice)
"***'s Watches INC is not an authorized dealer for the products it offers for sale, has not obtained the products it offers for sale directly from the manufacturer, and has no affiliation whatsoever with the manufacturer. As a result, wherever such guarantee is conditioned on purchase from an authorized dealer (for example ***), THE MANUFACURER'S GUARENTEE IS NOT VALID AND WILL NOT BE HONORED by the manufacturer. Details of ***'s guarantee, which replaces and supersedes all manufacturers guaranties, is available for inspection upon request."
In general, a Manufacturer's warranty card is supplied to a customer strictly as "provenance" from the previous owner, in conjunction with any other accessories still left from the original point of sale, including but not limited to boxes, hang tags, instruction manuals, extra links etc.
The warranty card is not be relied on as a receipt of original purchase, or a "functional" means to obtain manufacturer warranty service. As such, we make no claims regarding any PERSONAL INFORMATION that is filled out by hand on those documents, whether it's by the previous owner directly, the original authorized dealer who sold it to them, or a 3rd party not mentioned. The warranty is inherently null & void, and the physical condition of such accessories are meant to be evaluated accordingly at the point of sale when taking possession of the merchandise.
Customer fully inspected the nature of the product prior to purchasing. To claim that we have purposefully altered the original warranty card prior to selling is reckless speculation, that is patently false, slanderous, and defamatory.
Given the circumstances, we would encourage this customer to re-evaluate their position, alter their complaint, and enjoy wearing the watch with the understanding that they have purchased a previously owned timepiece, that was offered to them in "unworn" condition, factory stickers still intact, with a valid 5 Year warranty through our brick and mortar retail store.
